You both are correct (as am I) because there are exceptions to this rule based on pool level and how the land is deeded (especially in south texas) to include the water rights. This discussion is getting off the point. The post is about BANK FISHERMEN trespassing on his land, not kayak anglers and its posted here for some unknown reason????

Why do people feel the need to trespass to fish? There are a million public places to fish. Maybe this fishing hole is the best ever, but no matter if you catch a cooler full or just drown some worms, you are making memories with your childeren. I cannot think that catching any ammount of big fish would make the kids remember the trip if their dad got arrested at the end. They sure will remember. Even worse mimic. Poor kids.

Well I worded that wrong. I meant they wont remember all the fish they caught, just dad getting arrested. After reading that long QA about public or not, I am very glad I fish the coast, so much easier.

I think its acceptable to post this here as some of our fellow Kayakers will get out of their Yaks to fish. The OP seems to be talking about bank fishermen who walked in but its not out of place entirely in this forum. Some people take the right of portage to mean they can beach and get out and whatnot anywhere along a creek/river. After reading the TPWD link it seems the best policy is when in doubt ask the landowner for permission.

My understanding is, if you are unable to navigate the stream due to being blocked, you may go around on land. This was just under discussion on Bank Fishing and the YMCA apologized to our fellow Kayakers who had blocked portage and had to go around on their grounds. The Sheriff got it all straightened out, and no more ugliness from the YMCA camp councilors .
Take someone fishing and make them smile

respect, manners and decency still go a long ways, even in todays' world!  pretend i see this and start knocking on every door trying to ask for permission...  but no one answered. so, i GO FOR IT! then, i find myself at gunpoint being yelled at & TOLD "This is private property! U need to LEAVE!!! " its probobly best to say, sorry JLo, grab what u can then leave both quickly & quietly. cause getting mouthy &  with the land owner or law usually don't work out in my favor. trespassed before but was so quick & stealthy i didnt get spotted could have been scolded, escorted off, cuffed n stuffed, shot and or all the above n hospitalized then put in the pokie. while im in there maybe Bubba wants to go broke back or all silence of the lamb on me. DONT LET BUBBA GO BROKE BACK!!!  heed the signs

There are a lot of erroneous beliefs about trespassing and rights to water. The best thing is to educate yourself and even if law enforcement tells you the "rights and wrongs", see how his/her interpretation stacks up against code. It's posted here because we aren't Nazis in the kayak section, Big Redneck is a good friend to many of us, and it is still applicable if you try to launch or portage your kayak on private land. Yak'n Aggie has the right of it. Its posted here because we don't go ape $ h!+ over someone venting here in the yak forum. Especially when we all know big redneck as a yakker who wanted to vent about an issue,it doesn't really matter what law says what, the cops obviously sided with BR, he wasn't asking for legal advice he was talking to his buddies. If you want to talk about laws and argue start your own fishing law thread. Redneck being someone who saw his father arrested for dumb stuff, I see why you feel the way you do. Its crushing to watch your father get arrested, but after a while you realize its him and not the police or anyone else's fault.

Its a great discussion and from either side of the equation, something that everyone can learn from. As kayak fishermen its only a matter of time if you enjoy finding out of the way places to launch or fish, before you find yourself in this type of situation, whether intentionally or otherwise. Speaking from experience, learning the laws here is much more enjoyable than finding out the old fashioned way.
