Earlier this week two more trespassers was arrested on my property again. I dont like being a hard ars, but I have my own family to look out for. I'm usually nice and just ask them to leave, but you have them folks who cry easement or dont wanna listen. With many of us fishing rivers and creeks should understand all the signs.

Under Texas Penal Code(30.05). Criminal trespass occurs when one enters property after receiving notice not to enter. Notice includes verbal notice,a fence, sign(s), purple paint on post or trees, or the presence of crops grown for human consumption.

Out of curiosity, were they ignoring a sign, purple paint, tomato patch?

I agree, gotta protect your family. Sucks you had to deal with that.

On several occasions I have had folks walk their boats down the creek that feeds our lake.

I just remind them that the lake is private. I encourage them to enjoy their day fishing as my guest, and tell them if I see them on the lake again I will call the Sheriff. Seems to work out pretty well. I had one guy get lippy and I told him he could leave.

I saw his boat hidden in the branches by the shoreline a couple of weeks later. Someone had made a number of holes in it with a 9MM. I have no idea who....or at least I am not telling who.

The last guys passed six signs and crossed two fences, before I noticed them. The thing that got me worked up they had very young kiddos with them. I pulled the Dad away from the kids and asked them very nicely to leave, trying not to make the Dad look foolish in front of the kiddos. He got very mouthy and said he can walk the bank all and I cant stop them. I smiled and said you've got 5 minutes to pack up or go to jail. The sheriff was there in 8 minutes, I asked the officers to just escort them out because of the kids. The officers tried to be nice too and warned the two men over three times to leave, but it did not end well. I felt so bad seeing the faces of them kids watching there Dad being wrestled to the ground and put into cuffs. The officers really tried there best for a happy ending and avoid the arrest, I made sure to stay out of site so not to escalate the problem. I still feel bad over it and lost sleep over it. 90% of the time folks just say sorry and leave, but the other folks learned the hard way.
Getting the local law informent involved is a lot cheaper than going all redneck on them, been there done that.

Don't feel bad or loose sleep. Those kids see what happens when you mess with cops...and redneck. Just the fact they hopped the fences=doom. Never can be too careful.

When I was growing up there were a lot of places I could hunt and fish, but a few Arse Holes like those guys have changed all that. Now land owners don't want to deal with people and all their trash and there is to many liability issues from sue happy deadbeats and trip and fall lawyers.

I have no idea who you are and don't know anything about you.
Still though, I'd be willing to gamble a dollar of my hard earned money that if dad had come to you and said he had some kids who he would really like to put on some fish that they could have a spent a nice afternoon on your water.

Usually respect, manners and decency still go a long ways, even in todays' world!

Bigredneck... So they were bank fishing and this post is in the kayak fishing section because why?
News flash, IF they were in a kayak and IF the waters are navigable from a public launch, then you do not have a leg to stand on in court or in the field. They are only trespassing if they set foot on your land.

I have a guy who lets me fish his private pond, all I did was approach him and ask him, he said if I help him out with a little work I could fish it whenever. Never hurts to ask. I do make sure I leave with more trash than I came in with. Just because he had a problem with trespassers also. A day bailing hay was well worth a fishing hole and no trouble with the cops

Why do people feel the need to trespass to fish? There are a million public places to fish. Maybe this fishing hole is the best ever, but no matter if you catch a cooler full or just drown some worms, you are making memories with your childeren. I cannot think that catching any ammount of big fish would make the kids remember the trip if their dad got arrested at the end.
