This is desperately needed, but finding a way to effectively enforce it is the major issue. Seat belt laws are pretty effectively enforced and they are visual. No texting laws would work the same. After a period of time and a lot of publicity about police writing tickets most people will cease and it will become a habit not to text will driving just like it is reflex to buckle your safety belt every time to get in the car. There will always be a few that refuse to obey the law but if it eliminated 65% of the drivers doing it that would save a lot of lives, injury and property damage.
Retirement best job ever.

Against the ban. More government is never the answer. And as it was mentioned earlier, there is already a law against distracted driving.
Look how well the drug ban is working.
No way to enforce it. I use my phone all the time for the gps. How will a cop know I was using navigation and not texting?? its easy look at the phone Plenty of time to delete texts while he's walking to car. And looking at my phone is a violation of my privacy. "AM I BEING DETAINED!!??"  no more of a violation of privacy than a field sobriety test

The popo already do that Zeek. Yes, they do. The motive for doing so is to establish fault or liability. I'm suggesting that a texting ban law would add the motivation of citing for the texting offense.

Plenty of time to delete texts while he's walking to car. And looking at my phone is a violation of my privacy. "AM I BEING DETAINED!!??" no more of a violation of privacy than a field sobriety test Butch, there has to be probable cause to administer a breathalyzer, such as smelling of alcohol, slurred speech, dilated pupils, etc. Simply being in possession of a cell phone isn't probable cause to search it to see if a driver was texting before an accident.

what about when you see a driver swerving all over
with a phone in their hand? I don't know. I believe calling in a swerving driver is PC for that person to be pulled over. If the cop smells alcohol, they can probably start the field sobriety test. If you see someone swerving with a phone in their hand, I suspect that's PC for pulling them over and some sort of questioning by the officer might lead for a search of the phone, but I don't feel comfortable with cops being able to demand to search my phone because someone called in a swerving driver with a phone in their hand.

The Supreme Court (wrongly, in my opinion) ruled that, as long as they pull everyone over during a checkpoint, it's not a constitutional violation. By not answering their questions in a manner they saw fit, that probably counted as probable cause. The courts have also ruled that that, if you refuse breathalyzer, they can get a warrrant to draw your blood to test for BAC. I agree with you on the phones and that's why I think this is a bad road to go down. Distracted driving covers everything. If you cause a wreck because you're texting or eating a burger, it should be the same, in my opinion. I'm not big on handing my phone over to anyone, and my company isn't either. They pay for it.

The only wreck I have ever been in that was my fault was when I dropped my chick fil a chicken biscuit in my lap. I looked down and rear ended a truck.

Not a fan. Pull me over for tail lite and demand to see my phone because its on front seat. That phone and the info on it is mine. If they want higher penalties for causing a wreck fine. Don't see it going th right direction if it makes having a cell phone out probable cause.

My friend was decapitated while texting and driving when he rear-ended a semi trailer without a Mansfield bar at a red light. Yes, it might seem like an inconvenience, but it definitely needs to be banned to make the roads safer.

It would be alot simple if fone service cancekled out texting while gls was moving at speed.
I heard some one say the other day that the problem behind that is companies would loose millions in data charges by you nkt being able to access social media. Also think about the jobs lost with less traffic accidents happening. ..
