Lawyer up. This is the very reason Ranger, Stratos and Triton are fixing to go down hill.
 .....of course you happen to own a different brand that is 100 times better blah! blah! blah! .....you probably own the best brand truck, gun and tools also. All of that really helps the OP get his issues resolved. On a serious note lets stay on track and see what the outcome of this one is. A lot of us are curious to see how it plays out. The OP has been respectful and very composed so lets all do our part to keep it that way. Who $hit in your wheaties today? Your making assumptions. I never said anything about what brand boat I owned or have owned. Everyone on the forum knows BP Marine track record for customer service, and it follows that what got Forrest Wood's Ranger to being the standard by which all others are compared has gone down hill with each successive buyer. That's my point. And P.S. BassCat, Cummins Powered Ram, Browning, and Craftsman, so there..... You might want some iced tea with that popcorn.

I would agree with working with the dealer first, but I would have a time limit to resolve. If they don't get it done by that time, I would go directly to management at the manufacturer. I would also give a time limit to resolve. If they don't get it done, go directly to the CEO's office. Most large companies will act quickly when they receive a Presidential/CEO complaint. Often times, I've skipped the management step and have gone directly to the CEO. Once they get involved, even if it's an assistant to the CEO, things move quickly and normally end up resolved. If these steps don't get the issue resolved, I would then contact an attorney.

Just got off the phone with boat dealer and needless to say I'm not happy!! They said that they are not liable for any damage to the boat while being transported and that the bottom of the boat had to already be like that. Said there are a couple shinny spots in the before pics that could be sctraches? Wth? Then I asked him about the ones on the top and he said he didn't see those. I told him to go look again and look at pics!! They are offering a $300 gift card to basspro for the damage to my boat!! They have to be stupid! I'm driving up there on Thursday also going to call tracker myself tomorrow.

Call the local news, then hire a bunch of midgets to go picket the dealership. Nothing says a business messed up like an angry band of midgets on the local news.

Take it to corporate if the dealer won't help.
Also worth naming the dealership on here once this is all over with so we know who to avoid in the future.

Are we at a point in our society where no one does the right thing? Who is responsible for your boat during transport?
I hope this turns out OK for you. Unfortunately, it sounds like the dealer is going to be difficult.
If tracker doesn't do the right thing, I guess your only option is the legal route which can suck the life out of you.....

I would contact tracker and advise them to please resolve the issue or advise if you should go ahead and seek legal consult for the matter given the dealership's unwillingness to resolve the matter and correct the issue, one which was a manufacturer defect to begin with.
You are wasting time spinning your gears and getting frustrated with the dealership at this point. They have made abundantly clear their lack of desire to rectify the issue, and that they don't want to accept responsibility for a boat that was in their possession (which they ARE RESPONSIBLE for, I'm sure their insurance policy would agree in event of something happening to building while stored there) and furthermore they want to act defensive as though customers are out to get them. Circumvent their defensive attitude by contacting and dealing with the manufacturer directly, who should be replacing the boat anyways due to manufacturer defect, and then find yourself another dealer once they get it handled for you, elsewise lawyer up.
Just quit talking to the dealership before you muck something up somehow, no good can come form interaction with them at this point.

I went back and looked at your before and after pictures. I didn't see any before pics of the very bottom of the boat where the major damage seems to be. You have some good pictures of the front bottom. If you have pictures of the very bottom, it would be good to send those as well.

He called me and said that he had another deal for me, he said he was tired of dealing with trackers warranty department so he called the Vice President of tracker and told him what was going on. He told me to come pick out new boat! Said he doesn't want to look like a bad dealer and he would do what it takes to make it right. Thanks for all the advise and I will let y'all know what I decide on.
