I would reach out to fishandcoach to get his facts. To me it looks like it's been on the lake. Looks like stump drags and been beached on the bottom scratches. At this point I would look for a refund if you can prove they took it fishing after you took delivery and they were suppose to be repairing. If you can get a new hull take it and never return. Bet they try to paint and redeliver to you. Sorry man that stinks.... I'm sure that's what they will want to do but they won't be able to fix dents. I want a new hull. I hope it all works out.

That stinks, sorry to hear. Sometimes buying a new boat isn't so glamorous. IMO there isn't a boat dealer out there that is great. Good, yes, but all the ones I have been to over the years seem to think that you are causing a problem for them rather than them providing a service for you......and I've been to a bunch of 'em. I sure want a new boat but may never get one just because of the attitudes that I encounter when looking.
I wish you the best in getting a resolution for your complete satisfaction.

Obviously the dealer took your boat out on the water and treated it like carp. As others have said, try to work with the dealer if they appear to be reasonable. If not, work your way up the chain to the manufacturer. If that doesn't work, it's lawyer time.
I would demand a new boat or a refund for sure. Wouldn't even consider letting them fix that one.

I'd contact Tracker Marine direct, and get this squared away. That dealer isn't doing you right. Yup, this one sounds good to me.

those damages are clearly abuse. make sure all your correspondences are in writing and both the dealer and tracker are copied. nothing like a good paper trail. your before and after pics are money. they owe you a new boat. trying to fix that one will be nothing but years of trouble. they would eventually want you to sign something saying that your satisfied with everything to get them off the hook. start dealing more with tracker. they are the ones who are going to have to make this right. the dealer won't/can't without an ok from tracker. if you financed the boat get the lender involved. you can't stop making payments but you can escrow them. that will affect the dealer. i agree that your boat was used by someone who had access to it. this is something that tracker needs to be aware of. you can bet you're not the first customer they've done this to. do not take the boat off the dealer lot. let it sit there. if it leaves their place they'll claim that you caused at least some of the damage. they're goal is to minimize their damages to maintain their profit margin. insist that tracker send someone down to physically see the boat. the very last thing you want to do is to bring a lawyer into the mix. everything bogs down at that point. i wish you the best of luck in getting this resolved.

Heres an idea. Don't know how much spare time you have but years ago I went to a business and there was a guy standing out in the street with a sign saying "I regret doing business with .........". Later in the week I went by there and he was gone so I guess they got it worked out.
No business wants you standing out front with a sign like that. And far as I know its legal long as you stay off their property.
If you're too busy guess you could hire a guy to do it.

Could that damage had been done when they loaded/unloaded the boat to go back to teh manufacturer? I know they put them on a transport truck to do so.

Update: Talked to manager at dealer and he already had it in the showroom looking at it. I stayed calm and explained to him what I expected and we will go from there. Told him I wasn't taking the boat off there lot until it's resolved. He is going to call tracker next week and send them pics. I sent him pics from the day I dropped it he wanted them so they couldn't say it was already like that. So I guess now we just wait and see. So the fun begins.

no offense, but Screw that. that dealer has lost ALL credibility. go back & review your contract, contact the credit agency, hire an attorney but get out of that deal! guaranteed, even if they make right on this, you really have NO IDEA how badly your new boat has been abused. They'll have you sign some kind of indemnity agreement, then the next thing that happens (& it WILL happen) it's all on your back, & they'll most likely tell you to take a hike. take it to the top if necessary but get outta that boat!
experienced this exact thing w/ a new Nitro 17dc back in '95 Just cancel the deal & walk away is the safest approach.
