Why is river access and river usage an issue, and what can you do to help solve it? This blog starts the discussion, feel free to join in! My understanding of the law is not the problem. It is the lack of understanding or the refusal to abide by law by the property owners next to the river that causes the problems. I live on the Brazos River in Somervell County and understand the frustration of having people trespass on your land, especially if they trash the place. But I also don't understand the landowner standing on the shore of the Devils River berating me for legally canoeing down "his river"! This particular article by NOR actually answers no questions. Only makes the point that it would be less confusing to the tax paying user if the Feds & state were on the same page. Novel concept! :-)

Well said. I am on the brazos a lot and always try and leave the river cleaner than I found it. I have never had an issue on the brazos, but did have a an uncomfortable incident on the devil's the one time i went. Education would help a lot.

Is there anywhere on the website where it quotes the federal law? I looked around on there and couldn't find it. Looks like they want you to buy their book.
I would be interested in knowing what the federal law states. We were camping on a sand bar on the trinity river last year, and a Game Warden told us he didn't care if we were there, but if the property owner showed up it would be best for us to leave. We were way below the upper bank of the river, and quite obviously on public property.

Arkansas is very friendly to fisherman and kayaks on rivers and streams. As I understand it, as long as you are in the riverbed, you are on public domain. That said, there were bad incidents of landowners shooting at canoes on the Frog Bayou (which my Grandpa called Clear Creek).
I've also encountered a lot of fences. I understand these, as people keep cattle and they will escape without the fence. That said, it's a big problem if you have to portage around the fence through a cane break.

The last thing they want to do is come sort out the results after things turn ugly. The one time I ever ran into a landowner on the Sabine River he was fine with us fishing off the sandbar we had pulled up on.
