Hey I'm an old TFF poster that just recently got back on. One peice of Advice I would give is to check with a roofing company to see if you have damage from the storm. Your homeowners insurance could pay for a roof, the fence, any other buildings on the property, and any vent pipes or roof vents that were damaged. I know a very good and trustworthy company that can do it all for you and save your insurance deductible. So there would be no out-of-pocket costs to you. And your homeowners insurance premiums would not change.

if not in an hoa....
...neither property is responsible for installing or upkeep of a fence or boundary marker of any kind...however, if the old fence is on their property, they may be responsible for the removal of the debris...
...so, as far as putting up a new fence, you can;
1) wait them out and let them do it
2) see if they want to share costs of new fence
3) put up your own new fence ensuring that it is on your property...

If the posts are on your property it's your cost. You are actually correct. The house next to me is a rent house and the contractor for the rental property told me that since the post fall on his side, they are responsible for the fence.  The contractor just put up some new uneven metal post and reattached the old rotten fence. I am still willing to split the cost to get the fence replaced.

I build them like hop and coco mentioned. Other things I do are to put your first and last poles in the ground and string line between them about 6" off the ground. Cut you a scrap 2x4 to 94 3/8" long. Lay it on the ground as you go and it will give you the correct distance between the poles(if you are putting them on 8' centers). By one of those post levels at HD or Lowes, place the post in the hole, lay the board between the existing pole and the new one, level while keeping it against the string line. I also use a string line for my brackets to keep them parallel to the slope of the ground. I put my first brace 12" off the ground and my top one 6" from the top. I normally use a weedeater guard 2x6 or 2x8 along the bottom of the fence. Set your pickets up 1" to 2" off the ground to keep them from getting nicked up. sorry, 93 3/8" on the spacer Good info Thanks!

I think he out foxed ya with a bait and switch.
While your head was high fiving yourself with the "hell ya he's buying the fence", he was able to save the cost of a new fence by buying a few posts. He could care less about it, he doesn't have to look at it.

Also I'd toss my .02 in there and say if the fence was blown over to go deeper with the holes. You might hate the extra work now but deep posts make good difference in weathering a storm.
