For you guys on Falcon and Amistad the following applies to the throwable cushion:
Throwable devices must be immediately available for use. They should be on the main deck within arm’s reach, hanging on a lifeline, or other easily reached location.
Not many if any bass boats comply with the cushion being on the deck of the boat. You're exactly right. Was inspected by the US Coast Guard at Amistad in March and they informed me of this reg. I always had mine accessible but stowed until then. So I put it behind the seat and it blew out during the day. Had to get a new one that night and tie it down.

Also a paddle, whistle or some kind of signaling device and a working fire extinguisher.

My brother got a warning ticket, on Lake Hawkins, for not having it on and no old style vest in the boat. Warden as always was polite and instructed him why.

My understanding of the throw cushion law is on amastad and falcon they are concidered coastal waters, and fall under the coast guard rule of the throwable device must be on deck and accessable at all times. At least thats what we were told at the state tournament at amstad by the coast guard guys. From what i read on inland waters, it only has to be on board the boat. I can tell you this, its a chore keeping it on deck and keeping it from blowing out, I had to put mine under my console and stand on it at amastad

Get some of the 2 inch wide velcro self stick strips; stick them on the side of the step down area behind your front deck; put two on your throw cushion; stick it on the side of the step down area; it's now accessible and essentially out of the way. For those on the "coastal" waters of Falcon & Amistad.

Depending on what your coast guard rating is on your inflatable will determine if it has to be worn to be counted. TPWD law states that they must be used in accordance with coast guard regulations. the new HIT are rated as type II where the old style were not. read on your label what level it counts as and it should say when it is legal or not. For instance some will say legal for recreational when not worn but only legal on commercial vessels when worn.

i have two older inflatables <manual> that says on certification label typeIII , does the law retro back no matter what the label says ,to make it- a type five ????

Last year on Rayburn I was back in Hank's creek pulling up to the dock and had just taken my inflatable off (which was still hooked up to the kill switch laying on the seat next to me) when I got stopped by a warden. Since I had taken my inflatable PFD off, he told me I needed to have an old school PFD on the boat as well because the law said you have to be wearing the inflatable for it to count as a PFD. Well.....I didn't have one. Luckily he let me off the hook with a written warning. I won't make that mistake again.

There is always some confusion on this often mis-quoted PFD wearing issue.......actually there is no such written regulation stating that all inflables PFDs have to be worn to count. http://www.tpwd.state.tx.us/publications/pwdpubs/media/pwd_bk_l2000_0014.pdf Type II labeled inflatables PFDs such as the Mustang MD183 hydrostat model do NOT have to be worn to count on recreational boats in Texas. (It is not a type V hybrid PFD that has to be worn). Sounds like some wardens and anglers may still not be up to date nor have closely read the Texas regs, but thankfully, the local wardens here know them. They never have asked to see another PFD whether the Type II inflatable PFD is being worn or not.

You still might get a citation for not wearing it as it seems like not all Game Wardens know that a Type II doen't need to be worn. They view all inflatibles the same, having to be worn.
You should be able to straighten it out with the Judge but who wants to go through all that. I keep another vest in my boat all the time.

Recently I was told that having only inflatable life jackets on board does not satisfy the requirement of having life jackets on board for each boater. Do I have to have the old school life jackets in addition? I don't want to be in violation, and I sure don't want to have a possible pay check cancelled because I only have inflatable life jackets In the boat. Didn't read the other posts. If you keep it on all the time you are okay. If you take it off, you must have one in the boat stored for each one that has been taken off. We keep two of each in the boat.

We have the HIT ones by Mustang and a GW at Fork told us we must have the other PFD's in the boat to take them off.
