There are a couple of creeks on Palestine that have no wake zone bouys at the mouth of the creek. On one of these creeks the Bouys are gone, therefore, I have been treating it as a wake zone. Met a man at the back of the creek yesterday who told me to be careful, there is a lady that will writedown your TX numbers and report to the game warden. I said, "but the bouys are gone," and he said "Its your responsibilty to know the no wake zones and the "but the bouys are gone" excuse won't fly with the warden."

was he right? If so, where can I find a resource for official no wake zones in case bouys are missing?

Sounds ridiculous to me. That would mean that since I never fished that lake and never knew that buoys had been there could be ticketed for making wake??? I doubt that will hold up!!

My opinion is if they are not going to do their job and maintain the safety & navigation buoys, then they cannot really enforce it. Would you stop at an intersection that has no lights or stops signs? No, because there is nothing telling you to. Obviously common sense has to be used, but in this case I don't see how they can ticket you without the appropriate warnings signs in place.

I agree, but he said he knew the bouys where there. Does it make it right to speed threw there now just because the bouys floated off?

I definetely know it was a no wake zone, and the bouys probably did float off and it probably is still a no wake zone. The bigger question I want answered...do I have a LEGAL responsibility to know, or does tpwd have a reponsibility to post areas with bouys.

If it's not posted I cant imagine how you could be held responsible unless there is some sort of law that certain areas that aren't posted should be assumed to be no wake zone.

Kinda like in Texas, any County Road that is paved, that is not posted with a speed limit sign, it is automatically a 60 mph zone. Learned this after a 12 yo boy was run over and killed in front of my house back in 1999.

That's my thoughts. Instead of writing down boat reg. #'s and calling the TWP. She needs to call the TWP and tell them they have some buoys missing that need put back.
I can't see how they can give you a ticket for buoys that are not there, unless they have a sign at all the launch ramps that state "No Wake from the mouth of ______ Creek Cove upstream to the tailwaters of ____ Creek".

I wouldn't be too sure about not getting a ticket just because the buoys are missing. There are lakes in Texas that have no wake zones under all of the bridges, but the individual bridges aren't posted. It's stated in the lake regulations and is enforced accordingly, even though there are no markers visible at the bridges.

Depends...I know the 30 bridge on hubbard is a no wake zone...if the buoys float off and there are people fishing there I would slow down. If the buoys float off and no one is fishing the bridge then I would bomb right through!!

I live in County Line...I know the one you speak of...I live in the back...she hates me....No,, I haven't gotten ticketed, but I have fished her dock just to get a rise out of her after seeing her act a fool to some folks that were idling a little briskly...I informed her that she can call the warden, and he will tell you to stop interfering with a sportsman legally persuing game, and she only owns the dock, not the water under it...sorry for off topic, but I have no answer for the no buoy no ticket question...She has NO life...lol..sad..
