It's against the law to drink and drive ,and since 1 beer can put some people over the intox limit it's called BWI ..boating while intoxicated ,,you got off easy ,it could have been jail time!!

Maybe both were getting tipsy in the game wardens opinion. He may have felt they would soon reach the level of intoxication that would require him taking them in.
I enjoy a cold one myself. I do restrict myself to having one or two when I know I will not be required to operate an automobile. The same would be true if I was operating a boat.

fishin reports collector is a little off on his math. If a person drinks one beer then the estimated BAC for a person that weighs as little as 125 lbs is .002 g. That is WAY below the legal limit of .08. I in no way condone BWI but I see absolutely nothing wrong with a person having a beer or two while enjoying a great day on the lake fishing.

As for open container on boat, I was not aware that it applied. As for state game wardens enforceing city of Dallas regs. Not allowed by law. Maybe it was like the other post said and it was for thier own good.

Sounds like thats for 3.2 beer bassntexan try the stats for a breath test 10 min. after a 5.0 to 6.0 beer, this is the first test they give

ray hubbard is undre the laws of dallas county and it is illegal to have alcohol at any of the lakes that are in dallas county also in any of the parks, good thing it was a warden and not the dpd,he would have at least been ticketed then,

I'm with both of you guys, not against my religion at all to have a beer, but when I get home is soon enough. I've said it once and I'll say it again, being on the water requires all of your facalties, to me beer is not a good mix with boating, at anytime. Sharon Not against my religion either, I'm with ya Joe. I like a few brews on the water too. I just bring a sixpack of nonalcohol beer when I head out on the water. Some pretty good NA beers out there these days. You can even drop one in a cuzzie (hides the NA part) and the chicks won't think you're less manly. Wreck on the water is usually harder to walk away from...

NO open container law on MOST area lakes!! I am sure Gvine has some restrictions but best to know what is allowed on any lake you tend to visit. Now I like having rights, Im grown up but I see many posts that do not agree, they want the government telling me how to live my life. If I chose to have a cold beer while out fishing or a FEW than my choice!!!

I like to drink as much or possibly more than anyone on here, but just 2 little observations, about this topic. 1. When in doubt about what is or isn't legal, check with someone, preferrably someone that has some form of official capicity concerning the entity that governs that water body. 2. Just because people like to drink a beer, doesn't mean that they should be throwed in jail. When I get the chance to go out with my buddy on his pontoon on Richland-Chambers, since the state started enforcing the BWI rule, we don't take beer with us and we don't have any less fun. When we go out of Freeport on a Private Charter, then we do take beer, because the capt. and crew aren't drinking. I figure that there is a lot more to the original story than any of us will ever know.

Enough of the ranting and back to the question Skeeter22 posed. I checked the City of Dallas ordinances and while it is GENERALLY a violation to possess or consume alcoholic beverages while on park property, it apparently is a defense to a putative violation if the person is in a boat on a lake other than White Rock or Bachman. I guess it did make into a link. And since I'm a lawyer I need to add that no one should construe or rely on my prior post as legal advice, unless you want to hire and pay me.  Check for yourself and/or call your own lawyer for advice. And if you do get arrested or cited at RH, don't blame it on me!!! Be aware the City can change the rules with little fanfare. Heck, I still miss the good old days at RH when we could take a case of beer to Roberson Park and have bottle rocket and Roman Candle fights on the 4th of July. Whose idea was it to put an end to that kind of safe, wholesome family fun?
