federal court ordered EPA to delay the Cross-State Air Pollution Rule. The delay will allow Luminant to continue operating station as it had been, at least for a while. http://www.star-telegram.com/2011/12/30/3625675/federal-court-orders-epa-to-delay.html

It isn't power they offered a legal argeement the court thought MIGHT have some merit. There was no way these companies could immement what EPA thought they have the authority to force, in the time 6 months of time required.
Hey, EPA thinks you and I exhale and exhaust hazardous materials. We could be in big trouble if EPA catches us doing it cross a state line.
