Hi John,
I called them on Sunday (yesterday) and the owner/mechanic indicated that he had someone look at it (he was out of town last weekend), but he hasn't looked over the report, and will call me on monday (today).
I will call him shortly.

I just received a call from FLowing Wells Marine on Texoma.
They first tell me "Mr. Stewart....the motor is seized" (duh...it took you a 1 1/2 to tell me that) I told them that when I dropped it off.
I told him that what are we going to do about it since this is a result of the bowl falling off.
He said that since it has been the past 60 days since the carburator rebuild...they are not going to do anything about it.
I have only taken this boat out 5 or 6 times since I received the boat back from them.
He said that he couldn't tell, since there is no hour meter on the boat, how many hours are on the motor. He went on to state that there is no way for them to tell if someone else hadn't worked on the carburator.
So does anyone know the steps of taking them to court. I imagine this will be under $3,500 thousand to be fixed..
Steps I assume will start with:
1) getting estimage from repair centers for repairing/replacing the damage 2) filing a case with small claims court 3) be ready for battle. 4) collect receipt for work performed on the boat...including carburator rebuild, steering cable replacement, and clutch dog repair. 5) I already took pictures of outboard and are ready to present.
Thanks...as you can imagine...I don't recommend Flowing Wells marina in Pottsboro, Texas

I owned a 120 Force also, and I just finished an awful dealing with a swindler on a boat deal a month or so ago. I had to sue him in small claims court and threaten criminal action to get may money back. Anyway Does the reciept paperwork state the timeframe of warranty of any kind and if it has passed.If it does, I don't think your chances are that good. You should probably check with a friend lawyer if you know one. 1. Get all your reciepts and pictures showing faulty work together. 2. Go down to you county courthouse and get the suit paperwork from your area precinct judge. 3.Take your time filling the paperwork out. Write out the suit claim and give them your reason for your dispute. It will cost you approximately $12.00 to file the suit claim and $ 50.00 to have them served. If he files a counter suit it will then go to court. I didn't have that happen because the guy was guilty and knew he was going to lose. You will have to somehow prove that you only had the boat out those amount of times you say you had. If you had any one go with you on those trips this will work or any way of doing this. It will take time, he has about 15 days from the time he is served to file a response or a counter suit. I just picked up the boat yesterday afternoon, and dropped it off at storage.
I have 3 receipts in front of me from Flowing Wells. One for the Carbs rebuild, one for the new steering cable, and the last is for the clutch dog.
There is no statement about the length of the warranty, it just states. "I hereby authorize the above named business to perform the repair work listed above along with the necessary materials. You and your employee may operate the above vehicle for purpose of testing, inspection, or delivery at my risk. An express mechanics lien is acknowledged on above vehicle to secure the amount of repairs. Thereto it is understood that this company assumes no responsibility for loss or damage by theft or fire to vehicles placed with them for storage, sale, repair, or while road testing."
Nothing about a 60 day warranty.
The problem I had with this motor, is that Flowing Wells Marine was the only mechanic that indicated they would work on a "Mercury Force" outboard.
I think the only 'evidence' I have about the number of times I have taken the boat out, is the posts I have made (good or bad). Good thing I am consistant about posting my bait catching experiences.

I honestly can't see how the number of times you took the boat out has any bearing on their shoddy work. The only thing that should matter is the time frame of the warranty. Have a friend call and ask them how long they warranty their repairs. 60 days, 6 months, etc. Sounds like he's just trying to muddy the waters by mentioning how many times you've used the boat.
