The way the law reads on the books, if you catch and release the fish immediately, it is not considered in your "Possession". However, once that fish is retained in your livewell or other holding device, it is in your "Possession" and part of your daily bag limit of 5. Technically, having five in the well and having a sixth on board is a violation, but I've never heard of it being enforced UNLESS the angler shows up to weigh-in or the ramp with six fish in his livewell. What if you had five in your livewell, decided that one was too small or had the wrong color eyes, and pulled it out of the well and threw it back...meaning you now have four in your livewell. Let's say you then catch another legal fish and put it in your livewell. Have you technically broken the law in that case?

The ruling says that once in the livewell, cooler... that they become subject to part of your daily bag limit. Culling is a whole other matter. I think the catch that gets you by is that possession is twice the daily bag limit. Only 5 in the boat at a time but no more than 10 fish a day...

The way I read the rule is that they become subject to your daily bag limit...but only as long as you have them in your possession. If you throw a fish back in the lake ALIVE it is no longer in your possession.

bingo! Even though technically you might be in violation, once you have culled, you still only have five in your possession. Shake n Bake, that is not correct. You may only retain 5 fish per day. You may have a total of 10 in your possession, but not if they were caught on the same day.

The handbook never mentions culling. I have submitted a question to TPWD. When I receive a response from them, I will post it here. Technically, having five in the well and having a sixth on board is a violation, but I've never heard of it being emnforced... So, if you are fishing a regular tournament, are you legally done after catching your first five legal fish?

Their interpretation is that once a fish is placed in the livewell it has to be counted as part of the daily bag, even if it is released alive later. If that were true, culling during a tournament would be illegal. X2

You don't have to keep the first 5 keepers you catch. If released immediately, they aren't in your possesion.

I am President of a club and we hold three tournaments each year where we have two weigh-ins. Of course we are actually doing it on two different days. Ours are our night tournaments. We have a weigh-in at 11:30 p.m., wait 31 minutes and go back out at 12:01 a.m. with the weigh-in at 8:30 a.m. Some might say that this a two-day tournament, but we call it a continuous night tournament.

If I take them out of the live well and let them all go I have none in possesion, I can start over. Any way how can they prove I had a fish in my live well that I no longer have??? culling is not against the law,the pros do it at ever tournament!

You all are reading way to much into this. They are not in your possession anymore once returned to the lake. Yes you can go catch five more. It is no different than cullin fish.
Just like at a hourly big bass tournament. You could weigh in a fish each hour if you wanted too..No difference
