Guy's I just thought that if I'm required "BY LAW" to have my lights on, I would think the warden should have his lights on also. After all he was on the water at the same time. I guess I should have waited at the ramp and asked him just to see what his answer would be.

He probably turned his lights on when it was required by law to turn them on. I would give him and any Warden the benifit of the doubt.

maybe just go thank him for being out there to begin with next time.... its fixin to be bout time for those crazy jet skiers and the drunks to be out and about and i doubt anybody would be worried about their lights being on when they are going to stop one....

No matter, the warden was in the wrong. Being an officer gives no right to be above the law.

I have noticed most law enforcement types have very little regard for the traffic laws, or any other laws for that matter.
The sheriff departments in these small towns are notoriously crooked.
We had a Texas trooper out here for years who nearly ran over me several times barrelling out of the median.
I have had several bad things happen to me over the years and I have yet to get any help from the law enforcement types. About the best you can hope for is they will file a report.
Game Wardens are bad about coming up to your boat at full speed and swamping you with a wake. We had one out here who thought he was John Wayne.
All in all I cannot say I am surprised you had a bad experience.

For this particular incident, it's a good idea to give the warden the benefit of the doubt. Although any passing boat, to a warden, can be an offender, there are only a few wardens and it's not like you are out scouting for law breaking LEOs. Whatever his reason for not having his lights on, that's his call, just as an officer can run a redlight or drive down the street at night with his lights off if he's in pursuit.
Do officers break laws for no good reason other than immunity? Sure. Was this guy doing so? Seems like a piddly infraction for someone as powerful as a GW to commit just because he can, so I think an ounce of objectiveness and common sense can go a long way here.

I'm a poacher. I poach at night. If I see a Game Warden I stop poaching so he won't catch me.
Perhaps GW's should run around the lake with those giant search lights circling the sky so everyone will know who they are and where they are at.
When I'm not poaching I'm a car burglar. I break into your car at night when nobody is around. I love stealing your stuff and then listening to you whine and cry about how the police didn't do anything about it. Anyway, when I see headlights coming my way I duck and hide in the shadows until they pass. It's good thing that the cops don't roll by with their lights out. I sure like the law that says everybody has to have the lights on and that means to cops too. (Can you hear my sarcastic tone as I'm writing this??? I hope so.) Those sneaky cops that think they're above the law are the ones that I gotta watch out for. They actually turn their lights off and drive around in the dark looking for me, even though it's against the law. They just think they're above the law.
Some of you guys really are ridiculous.

From the original post it appears they turned on their lights when they had to, and did so enough in advance to be avoided. I guess I'm missing the issue here... I see cops sitting in places with their lights off watching areas, hiding behind objects shooting radar, even posing as construction workers. The wardens were just doing there job, IMHO. Well said. If you are not breaking the law, why worry about someone who is trying to get lawbreakers.

I would have made a citizens arrest. Sorry sucker on Roberts gave me a ticket for no lights after dark about 7 years ago. I had beached before dark well within the legal hours and I put my boat on the trailer after talking with a few friends. He gave me a ticket for not having my lights on for the 25 yards from where I beached to the trailer. Watching me the whole time. Needless to say I was pizzed. Thought he would give me a warning, so I was nice and calm before I saw he was gonna give me a ticket and then I gave him an earfull. Went to court and was told I would lose because I was legally wrong, but the bailiff said to the judge and the lawyer that it was bullshiz and they only made me pay court fees. All I can say is that I hope Karma catches up with him. Hard to believe that a judge would let his bailiff speak to him like that in court.
