Legally, time of day comes into play, and whether or not the property can be replaced does as well. My opinion, shooting someone over a jug is really stupid, if he calls the cops and there were any witnesses or they find the gun on you, you're SCREWED!
PC 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property: (1) if he would be justified in using force against the other under Section 9.41; and TEXAS CONCEALED HANDGUN LAWS 53 (2) when and to the degree he reasonably believes the deadly force is immediately necessary: (A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or (B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and (3) he reasonably believes that: (A) the land or property cannot be protected or recovered by any other means; or (B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

i am positive that i would not have any issue or regret with shooting somebody that was stealing my property or trying to hurt me or my family. Also there are lower forms of scumbags out there. Rapist, child molesters, people who commit crimes against the elderly just to name a few. Although that is obviously another discussion.

HOW MANY OF YOU FOLKS ON HERE THAT TALK ABOUT KILLING SOMEONE, HAVE EVER ACTUALLY SHOT A HUMAN ...TALK IS CHEAP...UNTIL YOU HAVE, JUST SAY YOU WILL JUST KICK THEIR ***, BECAUSE I DON'T THINK ANY OF YOU COULD PULL THE TRIGGER,ON A MAN FOR TAKING A FISH....SO STOP THE BULL, IT'S A LOT DIFFERENT SHOOTING AN ANIMAL OR BIRD THAN MAN.....NOW FLAME AWAY....THEN WE WILL SEE WHERE THE INTELLIGENCE LEVEL IS AT ON HERE...

This is kinda off-topic, as my story does not refer to jugs or lines. But a few years ago, when my wife was pregnant, my brother and I lived right next door to each other.I had just got home when my brother comes screaming into the driveway in his truck. He told me some dudes were road raging and following him. Just then I grabbed my 6-cell Maglite and a Burban with two Mexicans comes by with them staring at us. They kept going so I figured they thought they had an even fight now so they left.
Well I was right and they returned about 5 minutes later with a third Mexican in the truck, passed by the house, stopped at the end of the street and turned around. So I went for my 12 ga. and so did my brother. I stood at the door with it cracked open and they stopped in front of the house, trying to get me to come over to the truck. I told them they had no business there and needed to leave. They kept up and I showed them what I had. The driver scoffed and continued to talk smack, so I pointed that sucker at him. The bead on the end of the barrel eclipsed his head. Two fresh tire marks appeared in the road.
A little while later some cops came, the Suburban following. They got everybody's story, told us where they lived, confirmed they were gang members, gave us a lecture about pointing guns at people, searched their vehicle and persons, and went on their way.
As it turns out my brother was behind these guys on the road when they slammed on the brakes trying to get him to rear-end them, but he went around instead. They tried to pick a fight but ended up seeing the business end of my Ducks Unlimited.
Theives take the same mindset, no respect for the law or other people. These guys were thieves, they tried to collect on my brother's insurance. It seems like some of you assume that people stealing fish and tackle are otherwise honest, peaceful citizens and just need to be told not to do it. In addition, someone called the police in my case as soon as these Mexicans drove by the first time, and the whole thing was over before they got there. What are the cops going to do for you in the middle of the lake? And it's been my experience that if they don't actually see something going on all they will do is some paperwork, not actual work looking for thieves.
I wouldn't agree with shooting someone for taking your jug, but I would agree with a hole in their boat.

I fought in Vietnam, 1967-1968, with First Recon . I then served several months with CAP Lima 4, 1st CAG, 1st Marine Division around 10 miles out of Chu Lai on the Son Trabong River. I have killed and never desire to do so again. I do not carry a gun because of that. Killing another person takes a heavy toll on a human. However, I do have a temper and for that reason, I never carry a gun.

I dont jug fish but if i did and someone was stealing my fish i guess i would try to report to the game warden.
Take a kid Fishing the memories will last you and them a lifetime.

i think if someones so desperate to catch a fish that they have to take one off my jugline, then id let em take it. maybe they are just tryin to feed their kids, who knows. i sure wouldnt act like some inbred-jed and start shooting at them.

someone clarify fo me on this;only a couple here condon the use of firearms to resolve a theft. Firearms are now a specified item for fishing? Thought I have 3 children,3 yr Baby girl, 5 yr boy,should have seen his face when he caught his first 1 lb crappie, and a 13 who hates the outdoors,{cain't all be perfect but love him the same} I pull up to my jug and find someone running it.I pull my gun and cap a round or 2 into their boat/motor as has been mentioned. he pulls a gun and puts a cap in my ***. I die.No more children,taxes,bills,fishing,etc. Alternative,ease on up and comment how nice a fish and how big, get numbers and call in. warden will show up or sheriff, impound boat, motor and trailer plus possible vehicle and do a little time in jail, I get the fish since it was stolen and can not be held for court date. My children see the type of person I am and only further their belief that good will alawys win over bad and daddy does the right thing.I win all the way around with action 2. History lesson. I have shot and killed for B@E with intent. Lost very little sleep. Shooting for theft, would never even cosider the issue. I guess I could lower my standards and shoot at the motor or boat, hope one does not go wild and no one dies, like the 9 year old that the theif has in the boat with him that did not want to be there in the first place. You 2 guys and the rest who take that approach, I will watch for you in the papers.Since I do not cross this line that you have laid down, so I have no reason to fear your final say, I just hope that your actions are seen by your children and others as YOUR actions and that they do not represent those of others.
