Thanks guy's I appreciate all the kind words. I agree, I am not the sueing type. I really don't know what to do at this point!

I am not as concerned about the truck as I am about my neck and back. I sound like a bowl of rice crispies popping when I turn my head!

Sorry to here about that, we use to run a dump truck company and I carried General Liabilty insurance just for things like what happened to you.

Sue her for a new truck, loss of consortium, loss of income, discomfort, stress, a riding lawn mower and anything else your mouthpiece can come up with. She is negligent and should be punished while sending a message to all others who think their cell phone is more important than the consideration to, and safety of, others!

talk to a lawyer, at least know what your rights are..
don't sign anything till you do...hope not, but you could have bills futher down the road..
