I have a friend who was rear ended at a red light. The girl who hit her ran and she chased her down. They caught up with her and was able to retain her till the police got there. What a joke, gave her a ticket for driving without a license and insurance and sent her on her way. That means they let her back behind the wheel. Did nothing about the hit and run. To me this encourages people to hit and run. Everyone no matter what needs uninsured motorists, it's not that expensive and it well worth it. You would be surprised how many people are driving without DL and Ins. Another thing, cops usually don't do alot on private property. My mom had an accident a few years ago in a movie theater parking lot. The way it works you pay for yours they pay for theirs. That is what the insurance company said. Her uninsured motorists paid. If her comp/collasion had of paid her insurance would have increased.

it is the same as the insurance comp. do except the get paid by the people that HAVE insurance, with that said I believe big should be able to collect double the amount needed and cut the mans foot off to teach him IT IS THE LAW to have insurance.

Bigsteve I use day labor all the time and for the most part they are ok guys, I would bet he is an ok guy (better than the NARC)and you will most likely get your money to fix what HE broke.

I was hit by an illegal kid (15 yrs old) that ran and I had to run him down (on foot) kick his *** cause he fought me, and then I called the police, lucky for me the owner of the car he stole it from (a uncle) had insurance and I was taken care of.

Monday morning you call the local police that had jurisdiction where this occured.Tell them exactly what you told us and then report back as to who committed what crime.

Well, I hope you get to go fishing at the end of all of this. I had my boat stolen by an ex friend, and I am still trying to pay for the damage. I just try to live my life in a positive way and thank the good Lord that I'm not a dispensor of negative energy like so many people who cross our paths.
My x wife's car got hit by a young man from Chiapas with no license or insurance. Long story short, I paid.
Kicking his *** , cutting off his foot, or turning him into INS would not net me one red cent. However, if I got on the wrong side of the LAW over this, I can assure you I would be paying more. You might beat the rap, but you can not beat the ride downtown.

BIGSTEVE,I should have known you were in the F&B bussiness... I guess we all think alike.

There is nothing wrong with settling your accident out of court as adults. But if someone were to threaten me with bodily harm, deportation, breaking my legs for cash... that's extortion in my book. The proper thing is to trade information and present him with an estimate generated by a professional repair facility. He pays, you take him to court or file a claim on your UIM coverage. Simple.

Just to answer the extortion question: It would not have been extortion if the money was asked for and received. It became extortion when there was a threat added about calling the INS or police if he didn't pay up. A threat of whooping his butt would have been the same.

Basic rules I use are if you are blocking traffic, some of the vehicles can't be moved (In your case were you REAL SURE your trailer was safe to move with a boat loaded on it?) or there is any CHANCE of injury, call the police. Remember that not all injuries show up immediately. If there is ANY DOUBT about injuries, on either side, call the police. For anything else I always call my insurance company before anyone leaves the scene in case there is something else I need for them. Simply writing down license numbers and reminding everyone that it is illegal to leave the scene of an accident usually keeps everybody there.

If you don't have Uninsured Motorist coverage on your tow vehicle you should get it. It has saved my A$$ 3 times since I moved to Texas 10 years ago.

(It's amazing to me that I can get a $200 ticket for having a "I'd Rather Be Fishing" license plate holder on my P/U but uninsured/unlicensed motorists are often allowed to drive away from an accident with nothing but a warning. Which is the most dangerous?)

Mr. Sutton, you make excellent points reference this incident. But I tell you one thing, a Police Officer puts his career in jeopardy when he allows an unlicensed driver to drive away from an accident scene.(or any traffic stop for that matter) I'd hate for that operator to kill someone in another accident with a warning citation written by me in his vehicle. Not good for career advancement.

Insurance: I always issue a citation for no insurance, I'd like to think most Officers do. Its simple, I pay my car and boat insurance. If you drive on a public road, you should pay yours to. Its the law. On your second offense for no insurance, I arrest. I think the Legislature has realized the magnitude of this problem. Now, one of the new laws is on your first conviction of no insurance, $250 per year surcharge for 3 years just to keep your license. Now the problem, if they didn't pay their insurance, I don't know what makes DPS think they'll pay the surcharge. I for one hope this make people realize it is cheaper to have insurance. In our city a fine for no insurance is just under $300 for the first one, then over $400 for each subsequent. Someone mentioned it does not effect illegal aliens. This is a true statement, not much we can do about people who are here illegally. I think INS should be more pro-active. I'm not a racist on this issue. This Country is large enough for everyone, just live here legally. Its just that we shouldn't suffer for people who don't want to do the right thing.

I'm impressed with BigSteve, though. It's probably easy for all of us to sit here after the fact (hindsight) and tell BigSteve what's right and what's not right. But, as most people can argue, when you're in the midst of a car accident, regardless how small it is, your adrenaline is pumping and emotions can sometimes run wild. If it's extortion, a felony or whatever, I would be very upset if I was in that situation.

By the way, BigSteve, I believe your last name is pronounced Veeya-real. The double-LL is pronounced with a "Y" in Spanish.
