the only time water and alcohol mix is at the house with BBQ, my boat no alcohol,glass at any time ever. way too easy for something to happen on the water, your fault or not, and don't need the added problem of even slight intoxication. alcohol also increases hypothermia speed and will get you in trouble even in 70 degree or warmer water if in it for long time. just my personal preferences hope you have a good trip.

I've been looking online but can get a straight answer. I know (of course) its illegal to operate a boat under the influence. But, Is it legal to bring beer on a boat and drink it if you aren't the driver? Don't want to to run into this trouble with game warden. PLEASE MAKE QUESTIONS MORE CLEAR NEXT TIME. KINDA CONFUSING. Seems pretty straight forward to me.  Passengers can drink on the boat.

I wonder what happens to your car insurance if you get a BWI in a boat with a 40 HP motor? The law talks about 50 HP and over. i am not planning on doing anything stupid but was just wondering. I always thought that was a funny querk in the law. The way the law sounds from the TPWD, if you have under a 50hp motor, you cant get a BWI. Its dumb but it sounds like they are saying that if you have a jon boat with a 30hp motor cruising down the lake (which could reach 20mhp+) you are of no danger to anyone or yourself! How is that right? A 10ft jon boat with a 30hp motor can run like a jet ski and i know that there are some crazy people that would put that motor and boat combo together even though its unsafe.

They normally stop "those kinds of boats" for over the person limit and not enough PFD's. Anything more they "find" after that initial stop is just icing on their cake.

You should be sure your buddy is ok with it as well. Personally, If something happened to me as the operator, I would prefer to have someone capable of clear thought to depend on.

I love to drink but never drink and drive a car, boat, lawn mower or anything. I know that it effects my coordination.

I got a BWI a few yrs ago... I thought it was a joke. I was fine to drive the boat for sure, I blew a .097. It was a GW who just busted my balls bad, It was Fourth of July. Spent the night in jail. Got my boat the next day for like $300 which I thought was high to say the least. Ended up getting two weeks in Jail, along with a fine. Didnt think much of it. Problem arose when I got a DWI and it was actually DWI #2 b/c the BWI counted too. Anyways, bottom line I ran into a GW who was out of his region covering for the holiday, and I paid the price. Be really carefull not to go over .08, I had only had a few beers. I still drink beer while Im out fishin, but Im alot more careful. You can drink but you cant have a buzz....nice rule .08 is b.s.. IMO. Should be higher if I was really a .097 that day
