According to the Game Warden for NE Dallas County/Rockwall: If the community pond is accessable by public road then it is considered "public water" and state law applies.
We had some issues last year with non-residents cleaning out our community ponds and the above mentioned warden was called and issued citations for no license and fish violations (size/limit). He also mentioned while he was there that the city police could also enforce these laws.
This was June of last summer.
