Baylor Guy, this is Texas and believe it or not (outside the metroplexes, the "good ole boy" still happens. Not alot but I will guarantee it does.
Whether you like it or not....there's alot of truth in "it's not what you know but who you know".
We fish the Brazos outside of Bryan.....I know all of the game wardens. When they see my truck parked under a bridge, the only reason they stick around is to say hi or set down for lunch. I made it a point to be friends with them. Heck one of them caught the puke bags that broke into my house last fall. He could give me a ticket and I would still shake his hand.

Got a question.....can you stop by Mickey D's, get a fillet of fish sandwich and eat it on your boat???

Moral of the story; Never give law enforcement officers (of any kind) any more information than they ask for.

They ask you a question and you answer it and just stand there waiting for the next question. Make em work for it.

I understand the urge to try and get friendly with them but the fact of the matter is they are there to do a job. They are NOT there to be anybody's friend.

Minimum info in a minimum of words.

Friend or no friend, they are there to protect you and your vested interest (tax paying and fee paying). I, for one, would not want thier job because of the myriad thankless and misguided notions of "why they do what they do". Truthfully many of them are good people, contrary to popular belief. Far more often than those who purport themselves as "every day common folk". cheers

Most of the time, when the offender is upfront and honest, they will not impose the full fine, esp if he does not have any priors and a history of being a boyscout. However, every judge is different and might be more strict since it was during the holiday. Theres only one way to find out. Looking from the outside in, it does seem pretty shady and cannot be determined that he cleaned those fish off shore so it cannot be contested.

Whao! There partner!

The man is facing a criminal charge. The total burden of proof is on the prosecution and NOT the defendant. I'd have to look up the particular provision of the Wildlife Code that the man was charged under, but he may very well have a very defensible case.

Lawman, I have seen JP's change, and/or dismiss cases, once they have heard both sides of what happened. I have all the respect in the world for GW's. But, let's admit it, some are egotistical jerks that inteperut the law as they wish and get away with it. I was not ticketed, but saw a guide on a pheasant hunt get ticketed and the GW made up charges as he went. The local JP threw most of them out.

Sure, anything can happen. However I believe the original post clearly stated he messed up and was in possession of processed fish on the public waters of the State Of Texas. I did not read anything about the game warden drumming up charges? Did I miss something?

I too have all the respect for GW's and what they do, however I think in smaller counties they all don't play by the rules.

And in smaller counties the judge depends on, and takes the side of the GW since he is the "expert". I have a sore spot on the subject ever since the time I was fishing and caught my limit and put my 5 trout in my truck and went to give some tips to a F-15 crewchief student from Sheppard AFB. I gave him some bait and hooks and explained the best way to get them. I rigged a pole for him and tossed it in, then I rigged his second pole and the both got bit. He got one and I the other and we put them on his stringer then came GW (Mr. CANANANAN) out of some trees with binoculars around his neck. I explained I was only showing them how to get em. Would NOT listen to us and we offered to return ALL the fish to the lake. He refused, said they will die, and related it to me shooting someone elses deer. WHAT? I asked him how do they do it during a tourney when you get your limit and cull... he said that once you reach your limit it is illegal to keep fishing and cull out the smaller ones. Sorry but I lost all respect after that. I only give enough info to answer their questions, no less, no more.
