He isn't remotely responsible, would i have sat there with that going on? No but that said he bears zero responsibility

I see your legal point, would his client be alive today had he headed to shore?

What a ridiculous statement.

This will be ruled in a Civil Case in the future, bet on it!

No doubt the scum bag lawyers are already circling like sharks. It’s tough to run a business nowadays- always a target in your back. Right or wrong doesn’t matter they can break you defending yourself. Motor noise would have been everywhere- guy was hiding behind an island which one would assume is safer than the main channel. Any jury that finds him guilty is just as dirty as the lawyer that takes the case.

While I agree with your last statement, the family of the deceased maybe persuaded that they have no other choice but to seek restitution. I can visualize opening arguments, " would your client be alive today had you used caution and proceeded to shore instead of electing to remain in your position, yes or no?" As for now, prayers for all families involved and may lessons be learned in the future.

Both “professionals” could have easily prevented this. I would never run in the fog. I would never sit in the middle of the lake in the fog.

That’s like saying the person killed by the drunk driver was responsible because they were on the road.

Yes we’d have to live in a bubble to avoid potentially calamity that we would have the opportunity to sue someone else for. Never fly again because planes have crashed- the list is a mile long. It’s why insurance is so expensive- and to quote Mr Kennedy- it’s why the label on shampoo bottle has a warning “do not eat”

Watch for insurance companies to look into what they are paying out for these avoidable accidents and lobby for some changes that will cost all of us in one way or another.

If you fish tournaments, insurance cost will sky rocket.
