The state is going to have a black eye? If you're a restaurant or hotel and screw up you might get a bad reputation and go out of business. What's going to happen to the state of Texas? Are people going to move away because it used eminent domain at Fairfield?

You pretty much had it right the first time the State screwed the pooch big time. No sportsman wants to see this lake go private but since the State did not buy it when they had the opportunity they should have to pay thru the nose at this point. I think WAWI said it best in his post.

Okay, so I’m obviously not a “Guru” on TFF and suffer from a limited intellect, I’m not understanding your last post? It seems that you are saying Todd paid 90 million and if the state matches that and writes him a check, in your mind Todd is better off than taking the 25 million to walk away and let the state and Vistra hammer out a deal? While he goes to the bank and onto another development? You’re acting like the state has a mandatory obligation to repay Todd whatever he paid. I’m sorry but if the state decides not to, all the Attorneys in the world won’t make the state do something they don’t want to do.
I am glad to see your light finally came on, to the fact that I might know something that I am unable to post in a public forum. I also speak in generalities for that reason.
Personal question….Did your parents convince you that you are always right? Do you always have to get the last word? Did you always receive a participation trophy? The reason I ask, is because it seems like the most of the people here on TFF kinda figured it out before you did, a few pages back. On my last post, I just posted that you had said, a couple weeks ago, that the price had been set. I quoted you from (I think) the 14th. Nobody has said the state is mandated to do anything. Please quit making up new issues. When a piece of land is unique to the area its harder to set a price. One piece of information that would come into play on establishing that would be what was paid for the land recently and what surrounded that. They would look at how many bidders there were and what was the price paid and then the interest and offer the state made. That would all have an impact on evaluating the package. The state nor Todd sets the price during eminent domain. If you've seen the process you know but it will be set at a fair price that both agree to or if either party does not like what comes out of that they go to a civil court which will then be litigated. You're really arguing with yourself on the price point. As I pointed out, two weeks ago you said the price had been set. Now you are questioning what you said and me about it.

... Why does the state want to take it all? To my knowledge the state has not even started planning for that development. Where have we ever seen this before? The state is taking land before they have even made plans on what to do with it.
This is just a guess, but I suspect they want it all since it is technically a private lake. If they just took the park and Todd kept the rest, then you open up a potential situation where the state park is there, but Todd essentially says "stay off my lake." Owning it all removes any question that the state owns it and it becomes a public resource. They can plat it later and sell it off with the shoreline (whatever the topo level is) being the property line. That's not how it works. If you own 50,000 acres and build a lake that touches 10 foot of my land. I can launch a boat and fish it. You have to own the land all around it for it to be private That's not necessarily true. You'll have to get into navigable vs non-navigable water and whether the lake is defined as the property line or the line was established in/on the lake bed before the lake was impounded. Taylor Fishing Club v. Hammett, 88 S.W.2d 127 established that if the lake is deemed non-navigable, the owners only have rights to the portion of the lake that is over the respective owners' land and using the rest of the lake constituted infringement of the other owner(s). That's probably far enough down the rabbit hole since this could be argued all kinds of ways and I don't know if Fairfield is deemed navigable or not (floating a boat <> navigable). My only point in my original post was that the state probably wanted all the surrounding land to eliminate just this kind of discussion on control of the lake itself. After they own it all, there's no question.

I think Todd should receive fair compensation, which in this case should be what he paid for the land plus maybe a little for his trouble, but I don't understand the logic when people say they want the state to pay through the nose for screwing up. You all realize "the state" is us, right? If we want the state to pay an exorbitant amount, what we are really saying is that we personally want to pay a lot in the form of taxes and fees. The commissioners, legislators, and Governor aren't going to pay Todd out of their own pockets. We will pay Todd. All of us.

According to the lawyer press release above Texas Parks and Wildlife voted to seize the property. The description of the video by the news organization is a little misleading. I have seen nothing that officially states that the land has been seized.

Just like the TPWD people. Voting to do something is the same as not doing a damn thing.
