Allison, I'm thinking that while you and I have a shared passion for bass fishing. We obviously are miles apart when it comes to believing or trusting the media and statements from paid Attorneys. In my opinion, it would be hard to find an honest person in either of those professions. Add to this deal, politicians and state employees...yikes!! I was taught not to believe anything you hear and only half of what you see with your own eyes...lol This entire fiasco has been sickening to watch and all this back and forth, over hearsay and minutia is even more ridiculous. I was also taught that opinions are like A-sholes ...everyone has one and the internet just multiplies that. I'm sure the truth is somewhere between our two opposing views of life. Hopefully this nightmare will be over soon, since Texas is a fast take state and I can climb back under my rock, aka working 24/7 and not wasting my time bloviating on TFF. Here's a bonus old saying for playing along...Wish in one hand and sh-t in the other and tell me what you have more of....lol I believe that Todd bought the property.... that doesn't seem to be in question.

You can also take note of the things one side says and the other side does not respond to. You have to use common sense. The common question I ask, because I believe this comes up a lot when people are deflecting, is where do you get your information that you base your opinion on? I have seen some of us make up stuff that anyone can see to be untrue. Like the land only being worth $2k an acre. Like someone saying Todd told the state they wanted 50-100 million to walk away from the deal. The problem with your argument is that you should use that and only speak of stuff you have good reason to believe. I don't see that coming from you.

My last thought, hopefully, in this thread is about eminent domain and why its improper here at least to seize all that land and the lake.
They have the park that has value and they want to keep it. Thats appropriate albeit coming in late like they did was a black eye for the state. The lake itself and all the other land surrounding the park has no plan for its use. There is no need to take the rest of it if the question is what should they take from a private citizen for the public good. The state controls the water rights and people can fish on the lake, the same as all other lakes. If the lake was totally surrounded by Todds property that would be different. Why does the state want to take it all? To my knowledge the state has not even started planning for that development. Where have we ever seen this before? The state is taking land before they have even made plans on what to do with it.
It stinks IMO.
Now everyone be happy. I'll wait till this ends with an agreement of some sort.

The property is or was literally sitting on the Freestone appraisal district at $2000.00 an acre, when super Todd bought. I simply made note of the disparity between the asking price and the listing price. I never made any determination of fair market value, because obviously, if you had any common sense, you would know there are no comparable properties to this, closed or currently on the market. The state is not commenting or responding to Todds silliness, because they basically threw their hands up, or just decided to take it regardless. They are now treating it like the court case it will surely be. If you took the time to research the TPWD committee members that voted for condemnation, you would know that many, if not all, are super wealthy guys that can buy and sell Todd many times over. Buccees is not the richest dude on the board and Todd is not dealing with some bureaucrat, worried about his pension. You and some of your other bloviating sycophants here on TFF, spend way too much time pretending to be Gurus of knowledge, when actually you’re just nitpicking and wasting the time of people that actually work. You guys need to logoff TFF and discover that the internet is 80% porn and relieve some of your sexual frustrations. My common sense tells me, not to get in a gun fight with the state of freaking Texas, or several billionaire friends of Abbott, regardless of how rich you think you are up in the Dallas area. If that doesn’t make any sense to you, I really have nothing else to say.

If Todd gets to keep part of the land will the multi-million dollar homes he sells come with wakeboard boats and Aquathol K to kill all the vegetation included in the price?
The main reason Fairfield has remained a good bass lake is because there aren't lakeside homeowners constantly getting the authorities to kill the grass.

This is just a guess, but I suspect they want it all since it is technically a private lake. If they just took the park and Todd kept the rest, then you open up a potential situation where the state park is there, but Todd essentially says "stay off my lake." Owning it all removes any question that the state owns it and it becomes a public resource. They can plat it later and sell it off with the shoreline (whatever the topo level is) being the property line.

So here’s the wildcard and the main reason, I said in one of my earlier messages here, that Todd should have taken that 25 million for his crappy signs and marketing material and ran straight to the bank. As it turns out that 5000 acres is currently sitting on Freestone Central Appraisal District, with roughly an appraised value of 10 million dollars. It’s a given that Vistra is and has always, received preferential treatment from the county, but that’s a far-cry from the 110 million dollar listing price. It’s also a huge difference from the 92 or so million Todd is rumored to have paid. I’m not sure what he might say publicly, but if I was in his position, I would be very careful. If he continues to threaten the State and in turn pisses off the Freestone County residents, he might end up with a accessed value that is more in line with reality like $5000 an acre. If Todd is really having a press conference tomorrow, maybe he will surprise us all and announce that he is stepping aside and has smelt the coffee. If the State offers him anything close to breaking even he will be a lucky guy. The longer this goes on the lower his return will be. You didn't "simply made note of the disparity". Now you are using your own guesstimate as proof that it may be worth less than what he paid for it. Todd paid around 90m for it. That is one factor they will use. There are no comps in the area with the lake and improvements. My guess is they won't come to either you or me for that. What we do know is what we've read. I believe the state has said they've put 80m in building the park and improvements over the last 50 years. Now, show me where he the bad guy. He has retained a lawyer and is claiming the state has not been honest in their talks. Either you know something the rest of us don't or you can't see straight. Fact is the state has not said a single thing to back up that they responded to his counter offer. They just stopped talking and invoked their right to take. Thats how it works. One side says something and the other side responds, or just quits. Let me make a final guess. Its going to upwards of 100m or they will agree to a partial split or something like that. How much is the bet? 10m or even 25m....lol. Here is my reference to why I think you are wrong. You said so earlier on in this thread. Greg, I’ve been thinking the same thing, it hasn’t closed. Unfortunately however, I just checked the county records and Luminate/Vista sold 5000 acres including the lake and it’s water rights to Todd aka FLG on June 1. FLG immediately took out a loan/mortgage for 92 million from CMB to cover the cost. It looks like Luminate is out of the mess and took the money and ran. So now it becomes a pissing match between TPWD and Todd/FLG. I guess we will see if the state is serious about fixing their huge screwup. I’m like most Texans who don’t believe in the government throwing their weight around, but this whole saga has unfortunately made me a hypocrite. I’m hoping and praying the state will seriously pursue eminent domain against Todd/FLG now instead of Vistra, it’s pretty clear from the deeds on file that fair market value is now established at 92 million instead of the 110 million, plus the 25 million bonus they offered Todd to walk away. If Buccee/Alpin ends up saving the state 43 million and gets the park back, it will be the first time in history that the government actually saved money on a transaction. I think you had it right in the beginning. The state messed up and should pay for it, not the other way around. You've changed. and the state should pay for their mistake. According to Todd and so far not disputed by the state, Todd offered to sell the contract to the state for $30m instead of the $25 they were offered. If that is true then the state went through all this just because of $5m.

Okay, so I’m obviously not a “Guru” on TFF and suffer from a limited intellect, I’m not understanding your last post? It seems that you are saying Todd paid 90 million and if the state matches that and writes him a check, in your mind Todd is better off than taking the 25 million to walk away and let the state and Vistra hammer out a deal? While he goes to the bank and onto another development? You’re acting like the state has a mandatory obligation to repay Todd whatever he paid. I’m sorry but if the state decides not to, all the Attorneys in the world won’t make the state do something they don’t want to do.
I am glad to see your light finally came on, to the fact that I might know something that I am unable to post in a public forum. I also speak in generalities for that reason.
Personal question….Did your parents convince you that you are always right? Do you always have to get the last word? Did you always receive a participation trophy? The reason I ask, is because it seems like the most of the people here on TFF kinda figured it out before you did, a few pages back.

If you own 50,000 acres and build a lake that touches 10 foot of my land. I can launch a boat and fish it. You have to own the land all around it for it to be private

The state had the chance to buy it, they did not, you snooze you lose. The only reason I have even participated in this conversation is because I do not think Todd has any fault here, it is 100 % the states fault, now they want to flex their muscles, F them, I would take it all the way to the supreme court if I had to, they are denying a business man the opportunity to develop a pice of property that he bought, only because they received a few hundred emails raising hell with them, the state is going to have a black eye no matter how this turns out, jmho.
