Thanks for the input Ranger391. I knew my boat's problem may be hard to locate because it seems to be variable. We bought the aluminum boat I currently use for duck hunting at Dusty Rhodes in Lufkin.

Do you have a lemon law in TX? Here in MO I would be talking lemon law or get it fixed right now.
I have never had my Opti warranty done where I bought it because I like the tech at a different dealership better. Any Merc place should be glad to do your warranty work.

Texas has a lemon law for cars, atvs,RV, etc. My research is unclear whether it applies to outboard motors. If it does, I think the lemon law can be triggered at 30 days in the shop during a 1 year period. I know a couple of people that have filed cars under it. Right now my engine is 21 days in the shop in the first month. Lemon laws are a plus for the consumer since attorney fees are built into the settlement.
My focus though is getting my boat repaired and back to me. I spent over five years saving and manuevering to be purchase it in the first place. I don't want to tie it up for years in some legal debate.

sounds like you just want to go fishing to me with a great running motor...if ray roberts ever goes down, feel free to holler at me and I will will take you out there and put you on some fish.

The Triton is still at H&W marine. 22 straight days in the shop and 26 days in the shop of the first 32 days of ownership. About now, I wish I have never heard of Triton, Mercury, or H&W Marine.

I thought I would post a final update to this thread. On July 12th, H&W / East Texas Marine performed an on the water test of my boat with the proper computer equipment connected. They ran the boat for several hours without problem. I had a message at home from Mercury asking me to call the technician at the dealer. I called the tech Friday 13th and explained exactly the condition which triggered the problem. I was assured that the boat was gassed up and he would be on the water that day for a second test. I called back July 17 and the second test had not been done. I recieved a call on July 18 saying the second test was done that morning, the problem had reoccured, a replacement power relay and coil was ordered, and that I should be able to pick up the boat on thursday. I had no word from them on Thursday so I called this morning about it. I wish I had someway of typing the phone conversation verbatim or supplying a recording. I know everyone reading this would be suprised at what I was told.
The technician said that they had recieved/installed the parts and that he was going to take it an run it today and would call me this afternoon to come pick it up. I asked if I should plan to pick it up this afternoon since I have to leave the office early to get there before they close. He said and I quote here to the best of my recollection "If I get another phone call I'm going home and none of the boats will ever be ready". I honestly did not know what to respond to that, so after a few seconds of dead air, I requested that my boat fixed or not be brought to the front for pick up at 5:00 pm today.
I am done with H&W Marine/East Texas Marine. I don't plan on having any more dealing with them.

Sounds like you need to bring it to the big city and have it fixed. Oh by the way a main power relay or coil will not send it to gaurdian from reading your earlier post if it is going into gaurdian then there are 4 situations that will back it down to 3000 and they are Overheat,No oil flow, Batery voltage below 10.5 volts or faulty thottle sensor.......OPTI

a draper..here is my suggestion like I was saying before, it may be a little bit of a drive, but take out here to ft worth and drop it off at north tx marine...they have the best mercury master tech in the business. just to get you satisfied with the mercury, I have actually thought about meeting you 1/2 way just so you can see there are better techs then what you are dealing with.
