We just did this 4 months ago with TAD. You can download the exemption form, fill it out and mail it in. Just ensure you include the proper documents showing eligibility.

Yes. One person needs to be 65. We filed ours as soon as I became 65.

The nice thing is that you won't have to protest your tax appraisals anymore. With the over-65 freeze in place, most, if not all, of your property taxes will stay at last years level and never go up again regardless of your appraised valuation.

If you sell the house and buy a different one in the county, be sure to transfer your tax certificate to the new house.


So, what does that do, exactly? Mom is only keeping the house in Joshua because of the taxes...We're paying like $3600 or $3800/year (I forget) and most of the other houses in our neighborhood are between $6000 and $7000/year (some are over $10,000/yr)...Would she be able to get the same taxes on another house (amount wise), or is it gonna be locked in at the higher taxes? Because I just can't see the county being that nice.

Funny thing is, Texas has convinced us that not having a state income tax is a great thing...but the reality of it is, we pay a boat load in property taxes, more than a lot of people pay in state income taxes, and we can lose our freaking house if not paid. The money still comes from your bank account whether it's to pay the income tax or the property tax...they are gonna screw us one way or another. I'm starting to think I'd rather not risk losing my property.

Have any 65+ who own their home free and clear considered just not paying taxes (yes it is a legal thing) and letting it accrue and be paid when you croak? Not free as they charge a healthy interest rate, and the heirs will be shocked and dismayed but it is an option.

As much as I hate property tax, I'd rather pay it then state income tax.

When I lived in Texas I had the same attitude. Then my wife was forced into medical retirement and poof, there went $50k a year in income. But my property taxes kept going up. A state income tax is adjusted to the level of income you are earning. Texas didn't care about our loss of income, only to collect taxes on how much they think my house was worth.

First spouse to reach 65 triggers eligibility for the freeze. But you do have to apply for it.


Even then it doesn’t “freeze” all the increases.

Sucks for everyone that plans to live in their home for the rest of their lives.

Yes and no, it depends on what county you live in. If you have a disability or over-65 property tax exemption, you also have a property tax ceiling ("freeze") effective on the first year you have the exemption. In Lewisville, all three taxing entities - the school district, the city, and the county - have the tax ceiling applied. So no matter how high the appraisal goes, the property taxes don't go up. Other counties may not have a freeze on the county taxes, but the ISD and city are frozen, so the tax increase each year is minimal.

You should not be taxed on property you own. Period
