DR Horton cut down about 200 trees on my fence line that borders the Northstar development in N Ft Worth. I don't live on that property. Went the other day to check on cattle and discovered that 400 yards of boundary fence that had solid trees were all cut down since id been there 3 days prior. Picture is of one tree with property line stake next to it. ]

Texas law: If any part of a tree's trunk touches the property line the tree belongs to both property owners. The barbed wire fence was originally built over 100 years ago and has been maintained by my family ever since. Trees were natural growth. I estimate that 1/3 were entirely on my property, 1/3 entirely on DR Horton's property and 1/3 were common to both. So 2/3 of those trees were illegally cut down.

I contacted DR Horton's Project Manager. He said he couldn't find my contact info but "someone" told him to go ahead, that I probably didn't care. Then he said, "by the way , we are going to temporarily move the fence over 5 feet so we can build out retaining wall"

Texas law also says if you move a boundary fence you must give the other party written 6 months notice.

I am looking to heir an attorney to sue for

loss of shade for cattle.
loss of privacy
loss of wildlife habitat , i.e. roosting for dove and turkey
trespassing
emotional distress
value of trees

X 3 Treble damages for willingly and knowingly committing a crime.

any other thing a good attorney can throw in

send them a registered letter with notification that the moved fence will result in 1,000.00 per day fees for the use of the property with a 20 day minimum.

I would also go immediately and buy purple spray paint and paint at least every 3rd t post and both sides of any gates, that is a no trespassing mark in Texas.

Notice includes:

Fencing or other enclosure obviously designed to exclude intruders or to contain livestock;
A sign or signs posted on the property or at the entrance to the building, reasonably likely to come to the attention of intruders, indicating that entry is forbidden;  
The placement of identifying purple paint marks on trees or posts on the property (the marks must be at least one inch wide and eight inches long, placed between three and five feet from the ground. In forested land, marks must be made no less than every 100 feet. On non-forested land, marks must be made no less than every 1,000 feet).

Good luck!

Make certain you get a really good attorney who understands property laws. You’re going up against a deep pockets organization that has property attorneys on the payroll.

You are dealing with some real corporate scumbags that have MEGA money and attorneys. Ive dealt with them for 20yrs, they will out fight you with money. Hate to hear your predicament, but best bet is to talk to local reps. If you say they word lawsuit you will never find resolution in this century. Best of luck, but you won’t win a legal fight with them

Tell them to add a 6-8’ wall between you and their development , that’s pocket change on the development and we do it anyways. Good luck.
