D. R. Horton has a market cap of $34,000,000,000.00 whoever pursues them will have to have very deep pockets. This is just wrong but I think things like this happen every day.

This is just wrong but I think things like this happen every day. just hit facebook, twitter and any other social media they have. go after their public relations status and do it with hard core facts. they use that bs line of miscommunication and have since I worked in highlands ranch in denver, had horton, ryland and 2-3 other national idiots building there. all I did was some decks for a friend that was a builder. hope you find a good atty. and like said, make sure they know land law like trespass etc. just food for thought, should they come back on the property after being warned and you want to, call the gw and have them busted for criminal trespass. the bond money and legal hassle will put your msg out.

I don’t know Horton here’s a who; but fence/property line laws are taken very seriously in Texas. DR Horton is largest home builder in USA. Looks like they have a history. Here is before picture , cattle need shade , the SOB should have seen a big mean azz bull standing there and thought twice about cutting his shade trees down. In that pic all the trees appear to be on their side of the fence.

Be prepared that they may not be willing to take this on a contingency deal, basically you will be paying and that can be a hard go against someone big as them. The best you may be able to hope for is a few nasty letters and hope they work with you. While it seems like alot lawyers pretty much can make a good guess at what something will be worth to them. A comapny I was involved in went after a big company on a "principle based deal" and while the other company settled it was damn expensive, ie spent about 4 times in legal above the settlement. #not really winning..... legal fees were an ugly massive number. 7 digit after the decimal, 2 comma type number. This isnt nearly as complicated but..... have you considered asking them to compensate you for the time the fence is down, and maybe plant you a bunch of new trees? Maybe build you a nice new fence..... that might be a better angle to start with. You will probably be selling to them or some other developer soon anyway.

You might be able to get them to replant trees on your property, away from their retaining walls.
