I have a friend that got rear ended. Everybody’s OK although the car is totaled. The other person rear ended my friend and there are three additional witnesses. If the other person’s insurance company wants to give my friend a low price for the total, does he have recourse? He does not know how this works and neither do I. In other words, how do you go about obtaining a fair payoff for the totaled vehicle? Thanks in advance.

Yeah. We had something similar when my mom was t-boned. The other guy's insurance offered her a much lower price for her car than what it was worth. She filed on her insurance and her insurance company paid for the car (it was $2000 to $3000 more) and then went after the other insurance company.
The insurance needs to prove up how they came up with the price and he can dispute it by finding similar cars (miles, years, condition, options, etc.) for sale in the nearby area and seeing what they are going for. But get the car appraised by his insurance and file with them if they offer more and have them pay for it.

As a former insurance adjuster this is the correct approach. You pay your insurance company for a reason, the other driver's insurance company doesn't care about you or the customer experience they provide you.

I would also force their ins. co. to pay for cat scans or mris about a week after the wreck for all occupants. can probably do it thru the totaled vehicles ins. as well, the moron that rear ended me had no ins. and my costs were over 375,000 total for neck surgery etc. 3 vertebrae fused at bottom of neck to top of spine.
tell him to contact his ins. about a lawyer too, he may need one if medical gets involved.
just my experience.

They have 2 yrs from the date of the accident to file suit. They can figure out what all of their costs where and file against the insurance company and the person together. This is what we are doing for my wife's accident. In our case, we are also filing against the business owned by the individual. She has kept every receipt of every doctor visit and every mile that she incurred and every day she had to take off. We will anticipate Progressive will up their offer.

just my experience. ... and a thorough dental examination. I was involved in a similar crash several years ago and besides a TBI, it took about 18 months before discovering that I had six cracked teeth (uppers and lowers)...

You pay your insurance company for a reason, the other driver's insurance company doesn't care about you or the customer experience they provide you. That is the easier way to do it. If your insurance agent / company won't do it then find a new one.
