The Supreme Court of the United States rejected a church challenge on state imposed COVID-19 gathering restrictions. This is significant as it opens the door for previously unimaginable restrictions and government control at least until there is a vaccine, treatment, or tech solution that mitigates the risk of mobility during the pandemic. In one of the first posts about challenges to state restrictions I mentioned that you may not have the rights you think you have during a pandemic because of HENNING JACOBSON v. COMMONWEALTH OF MASSACHUSETTS. The SCOTUS referred to Jacobson v. Mass when they rejected the church’s request stating, “Our Constitution principally entrusts 'the safety and the health of the people' to the politically accountable officials of the States 'to guard and protect.' Jacobson v. Massachusetts, 197 U. S. 11, 38 (1905).” Stay vigilant in the days ahead.
