"As I have made clear through prior pronouncements, jailing Texans for non-compliance with executive orders should always be the last available option," Abbott said. "Compliance with executive orders during this pandemic is important to ensure public safety; however, surely there are less restrictive means to achieving that goal than jailing a Texas mother." Did she defy the state and the county courts when she tore up a cease and desist order? Surely there were numerous other remedies. But did she have the right to stay open? Should there be no penalty for openly defying the governor's EO and the judge? This is the EO from Abbott with the Texas law that authorizes his actions. Penalty for not abiding by his restrictions was listed as a maximum of 1000 dollars and 180 days in jail. WHEREAS, under Section 418. 173, failure to comply with any executive order issued during the COVD-19 disaster is an offense punishable by a fine not to exceed $1,000, confinement in jail for a term not to exceed 180 days, or both fine and confinement. https://gov.texas.gov/uploads/files...d_Activity_COVID-19_IMAGE_03-31-2020.pdfhttps://statutes.capitol.texas.gov/SOTWDocs/GV/htm/GV.418.htmI have provided evidence that the governor had the power to have an EO and that the judge had the power to assess a fine and imprisonment. What do those statues say about letting prisoners out because jail is too dangerous for them, then filling them back up with people who defy guidelines?

Someone needs to get financial backing to get on TV. Get on TV and say to the law makers "Have you gone this entire shut down without bringing home a paycheck? How many of you have been furloughed? Who's going to pay my business expenses? Who's going to pay my mortgage? Who's going to feed my children? Judges? I don't think so".

Governor Abbott should send the National Guard in to Dallas and set her free.
At some point this BS has to stop. Its not fair for one person to be able to work and another can't. I don't care what the over hyped situation is.
Thanks, Billy

Its a political mess is what it is. Let Abbott rescind his EO. He can do that. Make it all voluntary if thats what he wants.
He wants both. He wants people to abide by his EO and makes it illegal to violate it but does not want to enforce those same laws with the penalties he had quoted in his EO. If he doesn't want to enforce it, remove the EO. Its that simple.

The political grandstanding with this ordeal is nauseating. This wouldn’t be news if she wasn’t hot.

If she had waited for few days, she could have opened. Now she is missing out on another week of income. Common sense doesn't always prevail. Wait and see....

-If she had waited another week we would not have a case to test the random application of business closures and the power of local edicts.
-If the Judge would have deferred judgement another week we would not have a case to test the random application of business closures.
-If the Attorney General had not interceded we would not have a case to test the random application of business closures and application of the governor's EO.
-If the Governor had not injected himself into the case we would not have a case to test the random application of business closures and application of the governor's "voluntary compliance" EO.
I think this case should clear up quite a few questions of authority based on a compliant citizen. This case may expose the Constitutionally weak hand the government has over it's citizens.

I am picking she will be released early maybe even today or probably tomorrow. Strictly a guess but I think everyone is going to want this problem to go away ASAP.
