If she walks it's because the DA/Grand Jury upped the charge to murder. Will be a not guilty verdict... was a horrible accident. Not guilty, especially since they are charging her with murder. Remember, a criminal trial is beyond a reasonable doubt... The judge can instruct the jury to consider lesser crimes, such as manslaughter, if they can’t reach a verdict on murder.

Remember, a criminal trial is beyond a reasonable doubt... The judge can instruct the jury to consider lesser crimes, such as manslaughter, if they can’t reach a verdict on murder. You sure?

You sure? I am. The jury can find her guilty of murder, manslaughter or criminally negligent homicide, or no crime at all.

One other thing that seems lost on most. The Grand Jury.
The DA recommended manslaughter but, after hearing and seeing all the evidence that is just coming to light, the GJ upped the charge to Murder.
The DA certainly explained to them the burden of proof needed to decide whether she committed murder, manslaughter or criminally negligent homicide.
The GJ chose murder based upon the evidence and the DA's instructions on what constituted each of the aforementioned crimes.
The only question is if the jury can reach a verdict on any of those charges.

Reasonable doubt of what? The facts are clear. She stated them herself. She went to the wrong apartment and did not realize it. Went inside and shot the man there on the couch. Those are the facts. To wit that night she told her lover boy "I messed up. I am [censored]". She knew what she was talking about. Mess ups by the way people, even if not intentional, CAN BE CRIMINAL. Judge Dan grows tired of your nonsense. All of you who dont agree with me are in contempt.

The State has rested. The defense asked for a direct verdict of not guilty, denied. They then asked for a direct verdict on manslaughter, denied. They then asked for a direct verdict on criminally negligent homicide, denied.
The defense gets their turn starting at 0830 tomorrow. The Judge informed them that she would be holding court on Saturday.
That is all.

30% of the complex residents have gone to the wrong apartment. That’s going to weigh heavy on the outcome by the jury. She’s a cop trained to protect herself. She did what she was trained to do. I still say she walks. It was simply a horrible accident. 15% and she is NOT going to walk. And let's not forget, while an innocent man lay dying, she never attempted to render aid (CPR). She was on her phone texting. Screw her. Guilty. That badge does not grant her more rights than civilians. They protect their own. Lying dogs , i mean pigs.

If she were a civilian she would likely be convicted of murder.
Shouldn't LEO's be held to a higher standard than civilians?

Why would they not release the results of her drug/alcohol test? Seems like a valid piece of evidence.
