A military police officer taught my driving school class. He trained us that with good defensive driving habits (4 second bubble, always proceed with caution when approaching intersections, etc), the vast majority of collisions can be avoided
I remember him saying, that the philosophy on his base was that it usually takes two bad decisions by two drivers to get into a collision. If one driver is practicing solid defensive driving tactics, most collisions can be avoided.

Well back to the OP's original question. I think DUI is the appropriate charge. Some others make a good point that had the guy been sober he might have been able to prevent the accident, but we can't know that. Since we can't know, we have to stick with what we do know. The other car ran a red light and was a fault. This guy was intoxicated, but not at fault, hence the DUI charge is appropriate.
On a side note. Uber is cheap. DUI's are expensive. Ya'll just need to hang on a few more years and we'll have autonomous vehicles. Well said.

With Lyft and Uber plus the abundance of cell phones, there should be zero reason for driving while intoxicated... a ride home is hardly a call away. But the intoxicated driver will have to live with the fact he was involved in a crash that killed two people for the rest of his life.

It does take two people to have an accident like this. One person could just not run a red light and no accident. One person can recognize someone is going to run a red light and slow down or stop on green. No accident. Unless they get rear ended for stopping on green but let’s not go down that rabbit hole now.
Now, I question you this. For those who think the drunk guy is at fault no matter what let’s turn one piece around. The drunk guy, with a green light, GETS t-boned and dies. Is it HIS fault?

Here's the problem with that scenario, when intoxicated, your reaction time is slowed way down. If the driver wasn't intoxicated, he may or may not have noticed the other vehicle run the red light. It's a very sad situation to be in where a human life is lost.

It's a very sad situation to be in where a human life is lost. I want to know what the speed limit was on each road. if this was a 50 or better hiway neither may have seen the other. fast enough to kill 2 I would say is a 90% chance of 45 or better on each. jmo

They were prolly drunk too.
This happened to a guy I went to high school with, both drunk other guy got killed. Judge sentenced him to stand on the corner with a sign saying I killed someone while drunk. News crew showed up, he quit and was sentenced to jail. The mom of the kid killed puts flowers and teddy bears at that intersection all the time, it’s been 20yrs. Terrible for all.

So even though he was drunk it just so happened someone else caused the accident. Should he just get a DUI or something more? Based on the facts given, I think this one’s simple...he earned a DUI and nothing more. He (and others) can spend the rest of time on coulda, mighta...etc. but he’s guilty of DUI.

BTW - My Wife ran a red light while sober and was t-boned by a sober driver.

Exactly, I'm sorry but saying the guy was also at fault because if he was sober he could've noticed them running a red light is absurd. First, we don't know anything about the situation. How fast was he going? Was it one of those stupid red lights on a highway where he was doing 55mph? How quickly was the other car approaching their red light and how much reaction time did that allow the drunk driver? Was there something blocking his view from seeing the other car until the last second? We don't know, we weren't there. What we do know is it was determined to not have been his fault. DUI is the right charge.

People, the intoxicated driver was charged with DWI, not causing the accident. That is what he would be charged with had there not been an accident. And since we have so many experts here to testify that another driver should have been able to avoid the red light runner, tell us how you know that the intersection where the collision occurred has unobstructed visibility in all directions. And how you know how fast the vehicles were moving. And how you know what the road's drag factor (traction) was (assuming that anyone attempted to take evasive action). And how you know what evasive action was taken, and by whom............
Just wondering, since there seems to be so much unpublished, inside information about the event floating around here.
