I have been getting updated on a guest who continues to contact regarding his truck being broken into at one of the venues.
Seems he had lots of valuable tools and two guns stolen from it. He feels since it happened on our property we should pay him for his stuff.
Does that make sense to anyone? Not sure what the logic is there. And yes, as if it matters, there are signs that say park at your own risk and LOCK TAKE HIDE and all that stuff you see in about every parking lot anymore.
By this logic if my truck is broken into anywhere except on my property...even on a City street, the owner of that property is on the hook for my losses?
Strange philosophy but maybe I am looking at this wrong. Anyways the guy started talkin about lawyering up so I just sent the file to our legal team but yea....it takes all kinds I guess.
AND happy Hump Day fellas! Hope you have a good one. I have to go direct some stuff now. Just wanted to get yalls thoughts on this.

I dont see where its your companies responsibility to cover his losses. To me it seems like hes just asking, or threatening in this case, to see if you guys in fact will cover it. It never hurts to ask.

If he really wants to sue he can probably find a Lawyer that will take the case. Maybe he is a Lawyer himself. As for how successful he will be is another matter. Maybe it's a negotiation technique... talk with me and come to a settlement or I'll sue sue sue.

We have had all kinds of stuff like this over the years, people have figured out certain types of business have lots of insurance and have a tenancy to write checks to make little nonsense go away. I doubt seriously he could ever collect a nickle. I think lawyers spend more time figuring out how much insurance and money potential targets have, and I mean that just like it sounds so be offended lawyers, than whether there is any validity, merit, etc to the clients case. If you actually have a security guard they may try and say there was some implied duty. Reality is tools aren't gonna rise to any cost a lawyer would mess with anyway.

Its a negotiation position. He is trying to mitigate (lawyer word) the financial impact of being to lazy to remove his valuables.

Need more facts to render an informed opinion. In all posturing at this point. At first blush, i'd ignore him until he actually files - probably in small claims, if at all. I doubt he will file. In small claims, he must represent his own interests before the court - no attorney representation. For a couple hundred dollars in fees and court costs, he can afford to gamble on the Judge/jury rendering a favorable verdict; afterall, justice is blind and can be unpredictable. Based on the implied damages, seems extremely doubtful that he will file in a higher jurisdiction as this can be both expensive and time consuming and he not only bears the expense of his legal representation, hourly vs. contingency, but places himself at direct risk of incurring your legal expenses as well should he receive an unfavorable ruling...

Your good wouldnt worry about it weve had our trucks broken into at hotels . Nothing comes of it no matter who or how many calls /threats are made . Still sucks his stuff got stolen tho

I wonder if he might actually be guilty of a crime, It is his responsibility to secure his firearms. Locking them in a car I dont think meets the criteria for that reading this. You might ask someone in law enforcement or a lawyer about that. Copied this from the dps website about securing guns.
WHAT IS SAFE STORAGE? Safe storage of a firearm is securing the firearm in a locked object and keeping the firearm separate from the ammunition. It is also restricting access from unauthorized persons at all times - 24-hours a day, seven-days a week. It is more than keeping the firearm inside your house or inside your vehicle. Safe storage applies to where the firearm is all the time. It is more than hiding your gun. It is a constant responsibility and could be the difference between life and death.

Ask him to list all the things that were stolen, then the next day call him back and tell him you know a guy that has the exact same stuff for sale. Tell him you'll hook him up for a small finders fee.
