Got one of those lovely 3AM calls this morning from my 18 yo son. Truck is totaled. He was not driving and was not even in the truck.

He allowed his 18 yo buddy to drive it. I guess my sons truck was at another friends house. My son had left and went to whataburger with two other girls. The buddy calls and says some of the girls at the house are causing drama and he asked if he could drive my sons truck to go home. My son for some reason said ok.

The kid didn't make it 2 miles before plowing through a couple of trees and a pipe fence. Then, he decided to flee the scene (I'm sue you all no where this is going). Anyhow, I show up on scene before the SO or medics and we start looking for this kid. Won't answer his phone or anything.

SO and highway patrol show up and we get the statements made, truck loaded on a rolloff and the highway patrol wants me to drive him to this kids house. So, we get there and he starts his investigative questioning. He quickly goes for the breathalyzer. Kid blows a .067 3.5 hours after the wreck. Can't pass any of the other test either. The HP cuffs and stuffs him and off to jail.

Glad none of the kids are dead because it was one heck of a hit.

So now I am here trying to figure out what kind of insurance mess I am in. Will my insurance pay since my son wasn't driving? Do I file it on his insurance but will they over him since it was my sons truck??? How does the DWI play into this?

The kid pays the deductible, the insurance pays what truck is worth. Your son pays higher insurance premiums and learns another hard lesson.

Call your insurance. The kid had permission to drive the truck. Should be covered under your insurance. Your insurance may go after the other kids insurance or family. Thats for the insurance to figure out.

I've been told by my insurance agent that if you give permission for someone to drive your vehicle you're covered. This has been years ago, so things may have changed. With that said, the DWI will play into the investigation by both insurance parties, yours and the kid driving if he had insurance on a vehicle.

Sorry for what happened to your sons truck and glad everyone is ok. Valuable lesson learned on his part.

I hope your son's friend was listed as an insured driver on a policy somewhere....

This is what I think also the kid did have permission to drive the truck.

Bad deal, good to hear the kids are alright. I have never heard of the insurance not paying a claim. A girl here in town did the same thing, alcohol, and totaled out her friends vehicle who was not in it at the time, and the insurance paid. My son gets his permit in a few weeks, I cant say I am looking forward to it.

Permission has nothing to do with it I suspect. Stolen trucks are also covered.

Permissive driver is covered. Your insurance premiums will go up and most times a second permissive driver accident you will be dropped. At least thats how it was for my company when I worked at agents office. You got one but if it happens again with someone driving that isnt listed on the policy you would get non-renewed. Companies dont like paying for accidents caused by people they arent rating for.

Glad everyone is OK. Could easily have been worse

The kid in cuffs made several bad decisions
The kid in cuffs is responsible for the property damage
Hopefully he and his parents do the right thing by offering some help with the auto deductible

They werent in his pocket because they were frozen in a bowl of water. Chit hit the fan then keys started to thaw.

Im glad your kid made a good decision at the time not to drive. Ive always been told if nothing else the claim will fall on the policy holder if the other kids insurance wont cover it.

What is the penalty for a minor driving drunk? Since the standard is 0 etoh. Its going to cost the drivers family a lot more than the deductible. Maybe part of his penance will be to pay your losses.
