I don't believe you can get assault to stick if I have broken no laws and the cop can't control his dog. If it is that easy, cops don't need dogs Try it and then update us all on how it went after you get out of jail. I don't break any laws, don't drink or do drugs, don't run from cops, don't carry, and I don't r.e.m. er my last fight 25 yrs ago. If a cop had a K9 on me, he has made a mistake. There is plenty of precedent in the difference between bark and hold vs find and bite. Find and bite dogs are retired and their handlers will likely not be handlers long. If I am in my Jeep, I close the door and roll up the window. Why escalate the officers suspicion even if they are wrong. Comply and let them figure it out. The reason why is you can't fix stupid.

I always assume K9s are drug dogs. No problem here when one does their job. Airports have a bunch of them.

See all the outrage lately about police brutality is based on criminals who would not follow the orders given to them by the officers. Our wonderful liberal friends with their fake rage and protests. For ex, kid in Chicago doesn't comply, lifts his shirt and reaches for something and gets shot, the libs are outraged and protest. Yet, 7 young kids over the weekend get shot playing at the park, sitting on their front porch, walking to the store.... and yet not a single word.
Bottom line is people think they no longer need to follow laws or orders/directions from law officers and get outraged when the officer has to escalate the situation.

You can also be pulling a 22 foot bass boat and they will ask you if you are going fishing.

There has has to be probable cause or suspicion, some like to go fishing asking a lot of questions you don't have to answer. I'm not sure they have to present probable cause to you prior to asking questions but I've never considered the issue. Anyone have an idea whether law enforcement is required to tell you why they are asking you questions? "Why do you ask?" may be my new answer to questions.

if you got nothing to hide shouldn't be an issue... My head is about to explode...people still think like this? Please...for the love of God, go read the fourth amendment. Then look up some history on why it's there. If I was not breaking any laws, I would slam my door on the dogs head. Everyone is innocent until proven guilty. However, unless he stopped you just to harass you, or without cause, then yes, you have now broken the law. Remember, the officer does not know if you are the nicest and kindest soul on the planet, some DB who would slam his dogs head in the car door, or a hardened killer willing to kill him just for fun. You are as familiar to him as some guy on in a back alley at night in a bad neighborhood is to you. And that mindset is why dumb butts get shot! Just do what the officer says and worry about your rights later, while you are still breathing. Exactly. And if you were stopped/detained without cause, then we work towards getting the bad cop dealt with.

You do not adjudicate on the side of the road. Not one LEO is going to hold court on the side of the road. If you have not committed a crime ever or if you have the body in the trunk, it will always go better to simply comply with the cop. Court comes later.

So, the radio says to look out for a (whatever outfishdya drives) occupied by one (description of outfishdya) wearing (whatever outfishdya happens to be wearing today); wanted for an armed robbery that just occurred. And here comes outfishdya. So he gets pulled over.
Scenario #1: He follows instructions and cooperates, the officers quickly determine he's not the robber, and he receives an apology and is on his way. His rights have not been violated, he understands why the event occurred, and he's only been detained for a few minutes.
Scenario #2: He acts like the robber, screaming about his rights, and the situation goes quickly downhill. The officers (who know from experience that that's how the guilty ones generally act), ain't about to let go now. So now outfishdya has become a chew toy for the K9, he's enroute to the hospital and then to the jail, and a whole lot of taxpayer resources are going to be wasted on the criminal trial, the lawsuit, and the medical bills. Meanwhile, the robber got away because some moron needing a reality check had all the available officers tied up dealing with his idiotic and unnecessary antics.
Which scenario appeals to you?

As you get older and your testosterone decreases, this decrease allows one to think more clearly. Sort of a reduction in cerebral funtion blockage. The outcome of being alive versus being "right" takes over.
When the bar of lights come on behind you while you are driving do one of two things. One. Press hard on the accelerator and end up on the nightly news being chased, finally stopped, jerked out the window, not the door, being thrown face down and handcuffed. Possible tazed, possible shot, possibly killed and at the least given a tour of the nearest jail. Number two. Find a safe place to pull over. Keep your hands on the top half of the steering wheel. Don't make any sudden moves. Speak only when spoken to and hope the "comic" in you behaves himself. Don't argue or get into a verbal altercation because no matter how much you complain the chances of not getting a citation is about .5%. Never start a conversation with a LEO with "You can't do this". It won't end well.
I don't speed. I do the speed limit, except in Montana where I do less than the speed limit. Reason: There is no place that I have to get to that justifies a ticket that I have no joy in paying. I don't want my insurance company to have an excuse to raise my rates. My last ticket was November 6, 1976. Know how I remember the date? It was my birthday. Happy Birthday to me!!!!
