boat lemon laws

I have a 2 year old Tracker Pro 170 that has already developed 2 cracks in the welds in 2 different spots. One is where the bow is welded together and the other is where the side of the hull meets the bottom (this one is causing a huge leak). I dropped it off at Bass Pro and they called me back today to say that they need to send the boat back to the factory, cut off the entire bow cap, add more braces under the cap, and weld it back together. They also have to take the entire deck off, remove all the foam and repair the crack in the bottom. By their own admission, the crack in the bow is a design flaw because it doesn't have enough support braces. They are telling me it's going to take 6-8 months to repair the boat and return it to me! Meanwhile, I'm on the hook for my monthly payments and have no boat. Has anyone had any experiences like this or possibly know what other options I may have?

Wow is all I can say I have no idea what the laws are but you might want to consult a lawyer

I would recommend that you get a contact for someone in warranty at the factory and explain that to them. That seems very excessive for a wait time. They need to replace your hull with a new one or get yours repaired and back to you in no more than 6 weeks. If not then I would be calling for legal representation....good luck!

That stinks. I had an issue many years ago with my tracker boat. It was more the dealership than BPS. However, I didn't have any luck with pursuing the Lemon Law but I am sure things have changed. Also, I am not sure if one event constitutes a lemon. I paid cash for my boat back then. Had I just been making payments I would have just let them have it as it the problems started the first month. https://www.carlemon.com/state-lemon-law-statutes/texas-lemon-law-rights-consumer-guide.htmlYou might tell them you can stand in front of the Bass Pro store advertising the cracks in your Tracker boat for the next 6-8 months... As it would be beneficial for them to resolve the issue sooner.

I'd be going to the company directly. Waiting almost a year bc of their faulty product would not fly with me.

I would go up the chain and speak to someone with the power to make this right, as in replace the boat with a new one.

Also, your boat will depreciate over any length of time (and with major work done). I would contact legal assistance if BPS didnt make it right.

Go back to them and ask for supervisors and explain to them that this is unacceptable to you. Push for them to replace the entire boat with a new one or to compensate you in some fashion for the extended length of time that your boat will not be able to be used. If you can't come to a mutual agreement then go take a free visit to an attorney and ask him about your options. Sometimes you can pay the atty a small fee and he will write a letter making demands to the company and they will give in to and it is fairly inexpensive on your part.
I had to do that for a truck that I had signed paperwork for and left my trade in while they corrected the pre determined issues. They never corrected the issues and I would not take delivery of the vehicle and demanded my trade in back. They refused. They were actually very cocky to me when I advised that I would go to an atty and they informed me that they had many attys so go ahead. I followed thru. A free visit, the atty sent a demand letter with a deadline to return my vehicle and what he would file for in a suit, I received a call from management immediately asking me to drop the atty and they'd return my vehicle and void the sale. I think it cost me $500.
I would guess that if they gave you a 6-8 month estimate, in actuality you will probably not see the boat back for a year.

Good luck. This^^^^^ Many threaten but few actually act or follow through with threats. They knew they were wrong and didnt stand a chance but were betting on you being the many not the few.

Go to the credit union or bank that it is financed through. Get them involved in the situation and see what happens. After all, their buying it.
