I'd be interested to know what Huddleston's annual revenue is. I know you can't believe everything on the internet but manta.com estimates around $135,000 in gross revenue. Surely it's many hundred thousand otherwise what is the "infringement" really costing them? A lot of folks out there get patents so that hopefully someday they can win a lawsuit and collect a nice check because their "invention" isn't generating any money for them. They spend more time looking for infringements than growing their business.

Then there's always the large companies with deep pockets who try to unfairly profit off of the ingenuity and hard work of others because they have more money than the smaller company and they know patents are difficult and costly to defend.

Then there's always the cheap asses, who don't want to pay a fair price for hard work and ingenuity, that create demand for cheap knock offs.
I'm pretty sure some lawyers will take a good case on contingency.... but they won't defend one for free.

I hope Huddleston wins. Boyd ducket copied bucca without issue though. I wonder if BPS will squeak by, by claiming a "Slight" difference? I noticed that the Tail Hinge is single on the BPS and double on the Hud, also the dorsal fin is "Slightly" different. Look at the whole YETI/RTIC ordeal, RTIC was ordered by a judge to cease sales until proper changes had been made, i have 2 of the "new" RTIC's and 3 YETI's, still can't hardly tell them apart, other than RTIC has a drain plug on both ends. FWIW, I am in no way advocating Patent Infringement, folks need to come up with their own ideas!

I seriously doubt Huddleston is scouring the web for patent violations due to his product not generating income. He hand builds each bait in a very small shop. Its more about principle if I were to guess.

The 2 baits pictured in the article while similar dont look the same. Wonder what the infringement is in the parent. Almost looks no different than all the plastic worms or stick baits out there. You replicate an animal then they are all going to look similar.

David vs Goliath. David and his slingshot win every time. My personal opinion on BPS tackle is that it is cheaply made, and over priced. BPS is like a Buc-ee's, the store you have to stop at on the side of the highway to check it out. Tackle Warehouse for me.

I hope he gets a cease-and-desist AND a hefty settlement. Ken has busted his butt for years to develop his product line. For BPS to stop carrying his baits so they can profit with an obvious knockoff just isn't right. The financial benefit to BPS is an absolute miniscule portion of their sales but loss of profit to a small business like Ken's is significant. BPS greed. Plain and simple.

Extremely doubtful that it will ever make it to court as both sides develop their legal (not moral) positions and arguments. Determining the various damages will be challenging. I agree its David versus Goliath but in this battlefield, would argue that Goliath is typically heavily favored - right or wrong. Pre-trial legal representation is timely and expensive, trial litigation and subsequent appeals are lengthy and extremely expensive. Juries and the trier of law are unpredictable. If David loses, he very well may have to pay Goliaths costs and legal fees as reasonably determined by the court...

I hope somebody wins against BPS. They are the worst case of infringement. They bring baits into there store, if they are selling well they copy it and pretty much run a small manufacturer out of business because they put so much into ramping up their production to supply BPS. The way to stop this is in mass. If no body buys BPS Huddleson,Whopper Plopper, etc. knockoffs they will not waste their time and money trying to copy these baits.

They all do it how about Bull Shad same tail design , Innoactive Beaver bait went against Strike King case settled or not much of a patent Strike King won. The hold thing its like a joke put it out there and let competition handle it. Strike ring shad tale corn pants. LMAO, just had shoulder surgery and that one hurt!

I spend most of my time throwing swimbaits and I've refused to buy obvious knockoffs for 20 years.

The baits above are not involved in this lawsuit, these are 2 different brands; but he was making a point that Duckett pretty much copied the Bucca Bull Shad and got away with it. Bucca probably doesnt have any kinds of patents. Now there is a difference in the tail on the 2 in the linked thread, might be enough to slip by.
