basically the only thing you are going to miss is a night in jail, right? All the fines and court cost are still their they just dont have to house you.

basically the only thing you are going to miss is a night in jail, right? All the fines and court cost are still their they just dont have to house you. right. or a few months in jail if you can't afford bail. but they aren't exactly advertising it that way

I think citing and releasing for a Class A misdemeanor is stupid, and the city council stating that officers don't like having to go to jail for a petty arrest is a damn lie. We will still have to deposit the drugs downtown, weigh tag and bag them. And still do a report along with the citation. Please tell me how this is any better.
I'm hoping we will still have discretion to arrest once this makes it through the legal department. If we are going to cite and release for Class A weed arrest, might as well cite and release for a lesser charge of Class B DWI.
In order to make an arrest for weed, that usually requires some form of PC for the initial stop, if you have that PC then we can arrest for it and stack the weed charge. I foresee some officers taking advantage of the new cite & release, but your good officers will still place them in jail, as will I. does your opinion change at all for lesser amounts that would be a class B, and ultimately get thrown out or plead down in court? just curious overall I think it's a misguided policy decision Especially when you have Kingston tweeting stuff like No. People seem to place an importance on arrests based on the degree of the charge, a F2 is better than a Misd B, when in actuality it's really not. Is arresting someone for F2 criminal Lischief more important or a better arrest than arresting somebody for Misd B DWI?

That logic doesn't make sense to me. They are different things. And I'm biased, the drug war is stupid beyond words and I'm for anything that keeps people out of jail for a little weed. A few years ago the State rewrote the monetary value amounts related to theft (shoplifting), essentially decriminalizing unless its above $200. It used to be $50 or less and we would issue a citation, now I believe it's $200 and less (don't hold me to that). The amount of theft offenses reported has jumped exponentially because people have figured out that IF they are caught, it's a simple citation, all the while the stores have figured out that it's not worth stopping these people anymore for something they will be released from right there on the spot.

another question for big pig, if you catch someone with a minor amount (1/2 oz or less) that is self medicating with it, and can prove it (cancer etc) do you use discretion or is it all the same no matter?
just curious.
How are you going to prove it??? My dad has Pancreatic cancer, but looking at him you wouldn't know it. He doesn't need pot for his treatment. You're getting in a grey area for me, I feel for people that are in pain for various health reasons, and if pot works gen that's great, but you had better have a prescription for it and I don't think Texas has those yet.

It's 500 doesn't become a felony until 1500 unless it's a controlled substance (pharmacy) than it doesn't matter the value.

Why is having weed in your possession being compared to a DWI? If the new law states that anything under 4oz will just receive a citation then thats what it should be. If an officer will be looking for pc just to "stack the charge", they will find anything as pc just to arrest. That is not fair. Officers shouldn't be going through loop holes to arrest someone because they do not agree with the new law. I agree if they in possession of a controlled substance and MJ they should be arrested for both. If they are in possession while DUI thats a whole different story. Most people will wait to get home to smoke anyways.
