Bayman93, no offense but you are incorrect on every point you made. Undercover police do not have to identify themselves as police if the criminals ask them. It's funny a lot of them believe that police can't lie to them.

Undercover officers buy drugs from dealers, they don't sell them. It's not entrapment to purchase narcotics from a criminal while undercover. Last but not least police can call drugs by any name they desire.

Definition of Entrapment Entrapment is spelled out in Section 8.06 of the Texas Penal Code as happening whenever �the actor engaged in the conduct charged because he was induced to do so by a law enforcement agent using persuasion or other means likely to cause persons to commit the offense.� The law specifically states that providing an opportunity to commit a crime does not constitute entrapment. In other words, entrapment occurs whenever an individual is enticed to perform an act that he or she otherwise would not have committed.

Climaxing a nine-month undercover investigation, Texas wildlife officials have served arrest warrants on 22 of 24 persons charged in connection with the illegal sale of fish taken from Lake Texoma and its tailwaters.

Late last week law enforcement officers had apprehended all but two of the defendants, including two Oklahomans identified as J.C. McCullough and Mike Cobb, both of Cartwright, a community near the Lake Texoma dam.

Cobb pleaded guilty in justice of the peace court to 13 complaints: having no commercial license, delivery of stripers in an unmarked vehicle, sale of a paddlefish and 10 cases involving selling striped bass. He was fined $7,377.



















McCullough faces 10 charges of illegally selling stripers, plus having no commercial license and delivery of stripers in an unmarked vehicle. His bond was set at $10,000, double the amount of fines that could be assessed. He is scheduled for trial in Grayson County (Texas) on Sept. 12.



The other defendants are Texans, including 10 who have already entered guilty pleas in Grayson County. They were fined a total of $56,242. The judge agreed to allow the defendants to make regular payments on their fines rather than go to jail for failure to pay.

In addition to the individuals, warrants also have been served on two Dallas restaurants.

Bill Daniel, regional law enforcement supervisor for the Texas Parks and Wildlife Department, said more than 1,000 pounds of fish, mostly striped bass, were illegally taken from Lake Texoma and the tailrace each day during the big flood earlier this year.

Four undercover agents purchased 4,000 pounds of fish during the investigation. Daniel said the fish were bought for $1 a pound, sold to commercial enterprises for $1.50 a pound and eventually sold to the public for $4 to $6 a pound.

In addition to stripers, paddlefish and white bass were also involved.

Daniel said 90 percent of the fish came from either Lake Texoma or the Red River below the dam. The others were taken from Lake Lavon in east Texas.

Most of the complaints were on file in Grayson County, where 142 cases were lodged. Dallas County had 102, Collin County 71 and Rockwell County 30.

In earlier cases at Lake Texoma, officers had filed one case for each illegal fish, but during the latest operation only 10 charges of selling fish were filed against each suspect to expedite prosecution. BIOG: NAME:

Ok, so the Chinese lady is hungry and wants/needs the fish. You cannot sell the fish to her. Can you smile and hand her the stringer as a gift? I hope so...

I would definitely have given her one or more. I often ask the bank fishermen at the ramp if they would like some. I would never consider selling any. JMHO

But, it is legal to give your fish away, right? I don't see how that could be a problem.

it is not illegal to give fish away, But the law states you must give a written note to the person you give the fish to with your name etc so they won't get in trouble ( or something like that maybe someone with more knowlege will correct me )

You must accompany any fish given away with a note that has your fishing license number. name, date. The dept. of Wildlife has forms for this. You just have to fill in the blanks. If you are caught in possession of fish, you better have a license or proof that the person that caught the fish had a license.
