We were stopped in PA and asked for id. I gave the GW my DL and volunteered my CHL. He said that he had already observed the CHL in my wallet and asked if I was armed. I wasn't. He wrote me a "forgiveable" citation for not having the boat registration card with me and sent me on my way. Same guy stopped me 3 times the same weekend. He had different "helpers" on his vessel each time. The spouse suggested that I shave and get a hair cut.

and you are suppose to stick both hands out the window and tell them you have a permit and you have a concealed gun in the vehicle.

Whenever I get checked by the game wardens on the water I always show them my CHL along with my license. More times than not they ask to see it and we end up in a short discussion about which guns are better. I've never had any problems of strange reactions from a Game Warden. City cops and sheriff deputies have been a different story altogether.

I generally lay on the ground with my hands behind my back. Not really... Sounds like there are many different notions about the CHL laws. A fishing permit is not an ID. Anyone asking for a permit would be foolish to not require an ID to validate the permit holder. Once asked for the ID, you must show the CHL as well. It's courtesy to tell the officer whether or not you are armed, and ask what they would like you to do. It's not required unless you are asked, however. You are not required to even HAVE the CHL on you unless you are carrying, so you certianly aren't required to show it unless you are carrying. As to whether or not I carry on the water, that's for me to know.

I was stopped a few months ago by a Texas Dept. of Public Safety officer (highway patrolman) when he asked for my drivers license, I gave him both DL and CHL as I was told in the CHL class. He immediately handed the CHL back and said I did not need to show it UNLESS I had a concealed handgun ON MY PERSON. Wearing shorts and no shirt, it was pretty obvious I wasn't carrying. He explained the law had been changed. I would think it might be best to inform him that you do have a CHL and let him tell you what he wants to see.
As far as carrying on the water, check the authority that controls the watershed. I know LCRA does not allow carrying on any waters under their control.

Imagine you are the policeman. You get out of your car and approach the vehicle that you just stopped for running the red light. You ask for a driver's license. The driver hands you the license and says nothing. You go back to your car, run the license on the computer and see that the driver has a CHL. Your next logical thought should be "I wonder if he has a weapon on his person and I wonder what his frame of mind is?". You should be aware of any possible situation. Seems to me that you would now have to get out of the car again and go ask the driver, "Sir, do you have your weapon with you?" I thought this was the basis for the law of having to show your CHL at the time that you are asked to show Identification. I do believe TBILL, about what the DPS Trooper said. I just don't understand it completely. I guess, by not handing them the CHL with your DL, you are thereby indirectly informing them that you are not armed. Is there anything written in the Law that states this, because I can't find it?

Here's the law: 411.205. DISPLAYING LICENSE; PENALTY. (a) If a license holder is carrying a handgun on or about the license holder's person when a magistrate or a peace officer demands that the license holder display identification, the license holder shall display both the license holder's driver's license or identification certificate issued by the department and the license holder's handgun license. A person who fails or refuses to display the license and identification as required by this subsection is subject to suspension of the person's license as provided by Section 411.187. (b) A person commits an offense if the person fails or refuses to display the license and identification as required by Subsection (a) after previously having had the person's license suspended for a violation of that subsection. An offense under this subsection is a Class B misdemeanor.
Added by Acts 1997, 75th Leg., ch. 165, 10.01(a), eff. Sept. 1, 1997. Amended by Acts 1999, 76th Leg., ch. 62, 9.17(a), eff. Sept. 1, 1999.
Now, since I was not in my vehicle and it was obvious I wasn't carrying, that section does not apply. I didn't have a firearm on my person nor about my person. If I'm ever stopped again, I will do the same thing I did the last time...I will hand him both licenses. He can tell me I don't need to if he wants.

Geesh! A big Duh on my part. Thanks TBill. It was right there in front of me and I couldn't see it! I even posted this law on the 1st page of this topic so I suppose if I could read I might be dangerous. (a) If a license holder is carrying a handgun on or about the license holder's person when a magistrate or a peace officer demands that the license holder display identification, Thanks.

Glad we got that all cleared up. I've only seen one person share their experience with a Game Warden and it sounds like that went well. That's a good thing. Here's another question. Effective September 1st, people who meet the five criteria listed in PC 46.15(i) (aka House Bill 823) will be allowed to carry a handgun without a license. One of those criteria is that you must be in a "private motor vehicle". Just to generate some discussion, how many of you consider a boat to be a "private motor vehicle"??

Alsways carry a pistol and there is a rifle in the rod locker. Can anyone verify the LCRA regulation? I've never heard of that. Everytime I've run into a warden on Travis or Austin they could not care less.

i got checked last spring on canyon lake. i keep my wallet and pistol in a dry box. when the warden asked for my license, i handed her the box and explained to her my wallet and license were in there along with my pistol. she took out my wallet, looked at my license and told me to have a nice day.
