It's not a law. Like I said, look it up. I've had this discussion on here before, I could tell some of you guys the sky is blue, but since you see a sign that says it isn't, you'd argue. It's not a law, it's a resolution. The cops do still write tickets for it and people pay them. If you challenge it, it WILL be thrown out. Because it's not a law. Try to find it in the Texas penal code. You won't. I know about this in depth. I was privy to a court hearing where the judge told the PA to show him in the penal code what the law stated...after about 30 minutes of looking he PA had to admit it wasn't in the books. Because it's a resolution, not a law. You can argue til you're blue in the face but it won't change the facts. Most cops, GWs, and judges aren't aware of the facts related to the no wake signs. It's nothing underhanded, they're trying to keep people safe. But the facts remain. . .not a law, posted or not. I can walk out to my dock and post a no wake sign on it. . .how would the authorities know if it was legit or not? That's a big part of the reason they won't make it a law, because different county authorities and sometimes HOAs post those no wake signs.

Again, if you think I'm wrong, take 5 minutes to look it up instead of arguing with me. Because I'm right.

Texas Wildlife Code 31.127. Look it up instead of arguing with me. But you'll also need to go back and read definitions, and what is stated about who can enact restrictions and who can enforce those restrictions.

On Ray Rob this weekend. I put in at Buck Creek behind three other boats all of which jumped on plane and were running 45 to 50 when they went under the rail road bridge, I got on plane as well but as I came to the bridge I saw a gent in a 2 man bass buggy on the tree line just past the bridge so I dropped to idle before I got to the bridge. When I got close he yelled at me and waved so I killed my engine. He told me thanks as I was the only boat that had bothered to slowed down and didn't wash him into the tree line he was fishing.

I'm gonna have to side with Fouz on this one...I'm gonna bet a GW could give you a citation under either of these statutes. One being a misdemeanor and the other being more expensive.

From Fouzman's post above:

Texas Wildlife Code 31.127
31.127. PENALTIES. (a) A person who violates or fails
to comply with any provision of this chapter, or who violates or
fails to comply with a proclamation of the commission entered under
this chapter or a city ordinance or order of a commissioners court
or a political subdivision of the state made or entered under this
chapter, commits an offense that is a Class C Parks and Wildlife
Code misdemeanor.
(b) A person who violates Section 31.043(c) or 31.096 of
this code commits an offense that is a Class B Parks and Wildlife
Code misdemeanor.

(c) A person who operates a vessel in violation of Section
31.021(b) or 31.095 commits an offense punishable by a fine of not
less than $100 or more than $500.

31.096. RECKLESS OPERATION AND EXCESSIVE SPEED. No
person may operate a vessel or manipulate water skis, an aquaplane,
or a similar device on the water of this state in wilful or wanton
disregard of the rights or safety of others or without due caution
or circumspection, and at a speed or in a manner that endangers, or
is likely to endanger, a person or property.

31.095. EXCESSIVE SPEED. (a) No person may operate any
boat at a rate of speed greater than is reasonable and prudent,
having due regard for the conditions and hazards, actual and
potential, then existing, including weather and density of traffic,
or greater than will permit him, in the exercise of reasonable care,
to bring the boat to a stop within the assured clear distance ahead.

I think it needs to be a law, on all lakes, and I don't crappie fish, it just makes sense to idle under bridges! I fish fork a lot and I have a fast boat but I normally do about 45-60 mph just watching out for other people!

Fouz is absolutely correct. Also any peace officer can enforce Texas Parks and Wildlife code as well as Law Enforcement officers who have taken and successfully completed the Marine Safety Enforcement Officer class can enforce and cite violations of the Water Safety Act.

Can't say I'm surprised. I've only lived in the DFW area for a short while, and these are some of the rudest, most inconsiderate boaters I have ever seen!!

Not sure what lakes you go to but I think Texas has some of the more friendly boaters

The sad thing is Fork attracts a lot of fisherman. If the number of idiot boaters are proportional the number of boaters, Fork will have a lot of idiots on a weekend. I like the idea of the Go Pro. Maybe if the GW started annoucing they were going to start issuing tickets based on video evidence, maybe some of the half-idiots will slow down. Don't expect full idiots to do it. Just not in their ability to understand.

And to the serious side, wasn't there a fatality by one of the bridges on Fork just a couple of months ago when one boat t-boned another.

Go check out Lewisville or Ray Hubbard on a summer weekend... Idiot factor off the charts. Fork boaters are nuke scientists compared to those maniacs out there.
