Waste of Fish – It is unlawful to leave edible fish or bait fish taken from the public waters of the state to die
without the intent to retain the fish for consumption or bait.

That is straight from the 2013-2014 game regulations for Texas. Now how can you release a crappie that is dying just because he is 9". If you keep him you break the length limit, if you release him you break the waste of fish laws.

Anyone know a game warden or a state judge that could answer this?

Somehow I feel I should blame OBAMA for this!!!!

How is it contradictory? The fish isn't of legal size so it doesn't qualify to be edible.


If the fish is short, then throw it back. And putting them in a cage to hold at a certain depth isn't a good idea either, since you have them in your possession

If your that concerned learn how to fizz one, even if your kill one out of 10 your atleast trying.

I'm assuming you can't throw legal sized edible fish back to die? If it's too short it's too short?

Tie a brick to the end of a string.

Tie a clothes pin to the string about a foot up from the brick.

attach said crappie to string with clothes pin and gently lower to desired depth.

when device is needed again just give a swift jerk.

I have always thrown undersized fish back. It is totally opposite of the way my daddy taught me to fish. Throwing back fish was the same as taking food from your family. The fine for a undersized fish is not worth it.

I gaurantee you that a 9.5" crappie is edible. and I know how to fizle a fish, but incase you don't know this fizzling only reduces mortality rates by about 10-20%. That still leaves a lot of "edible" fish floating.

I sort a think it ruins the visual capacity of the fish if it does survive the needle puncture ?

Saw a fisherman on Sunday catching a few under a bridge. You knew he had one because you could hear his reel singing as he was bringing them up so quickly. A quick unhook and then a flip back into the water they went. There where a few floaters around his boat.

Question is, do you say something to them and risk a confrontation or do you keep fishing and just shake your head? I wonder if a GW would have saw this could he have been ticketed?

I don't see how he could be ticketed as he was returning the undersized fish to the water.

Had you said anything he would have probably been angry.

But he may not have realized his actions were causing the fish to die. So I don't know how to answer your question and will be interested in hearing other member responses.

Other than giving him advice on how to return the fish to the lake there not much you can do. There is good chance that he had no idea how to save those fish and was only doing what the law required.

Pretty sure what a game warden would do because that's their job but would like to hear their opinion on this subject. Maybe all Texas lakes (with deep water)should be included in the keep what you catch rule during the winter. Granted there are those that will keep a small fish regardless of conditions and they are a whole different subject (poachers!) but keeping a small fish because it is going to die anyway will make an honest man a criminal under the current laws.
