As-Is was a loop-hole to the Lemon Law. Unfortunately for you, As-Is means just that, and IMHO you have no recourse. And since the problem was a sudden failure of a part, there would have been no way for them to know about it, so there is really no intent on their part.

That being said, I would think it would be in their best interested to at least assist you in some manner. Possible provide at least the labor.

That would really suck...I feel for ya.

I feel bad for you, Arkansas Basscat. It sounds like the dealer already hired an attorney to draw up the paperwork for the sale. 'As is' means 'as is'. It is not ethical, but they most likely have you over a barrel. The best chance you have to make them do the right thing is print off this post and make them aware of how many people from North Texas hit this website every day. If they do the right thing by you, a follow up post saying what they did could restore their reputation with us. For now, I'm just mad

Hey remember you live in Arkansas not texas you are bound by your laws and so are they. They sold you a boat a with your home address did they not. look up your laws

I am sorry to hear of your misfortune with DFW Boats. I was looking at buying from them. Posted here on this board and got to much negitive feed back about them. Every time I would talk to them they seened to pushy to me. He said if I didn't buy the boat he was going to raise the price 1500 due to the boat shows. I didn't buy he raised it 1500. That tells me alot about how they do business. Hope you get something out of them.

The 3 day cooling off period is basically a myth. It is a law but only applies if you were NEVER at the store/dealership. The law was origanally written for people who bought something from door-to-door salesman to make them go away.

Sorry about the bad luck with the lower unit. When I was looking at boats I looked there & they offered no customer service. I saw a boat I wanted but service means a lot to me.

The part that broke was Mercury. Call Basscat if you wish, but they will only refer you to Merc. If it helps at all, a friend of mine is picking up his Merc 250 today, he bent the driveshaft, which in turn, started making the seals not work properly. He is paying just a few dollars under a thousand, and the parts on that thing are mercury racing parts. Good luck.

I have been down this road with an Austin dealership concerning repairs on my boat, Texas does not have a lemon law that applys to boats unless it is a new law since my troubles in 2003. However, I "highly" recommend that you go to the BBB as it does get their attention. I lodged a complaint against them and did not back down when the dealer tried to soften me up. There perfect record is not "perfect" any more. If you are in Del Rio and have a problem check out Two Guys Marine and ask for "Binky" as he fixed what the dealership in Austin could not after 5 or more attempts at it.
Since we are talking about Dealerships, my dealer in San Antonio which is Anchor Marine is super!!!!

Why do so many people think "As Is means As Is" is unethical? They sell on consignment, they don't knwow what the boat has been through. They provide a service, true all it is is a lot to advertise a boat on, but how is it different than selling a car privately on one of these raodside lots?
If you sell your old truck privately and the main bearing goes out after the buyer drives away, are YOU going to pay for the repair, or did you sell it to him "As Is?"
Your predicament sucks, but you signed on the line with those conditions stated, correct?

Dave-if you knew the bearing was going out and you with held that little bit of info...then yea if he takes you to court and proves to the judge you knew it and sold it to him without telling him, you pay.
The only thing I do know is if they sold it to you knowing that there was a problem. Then you have a case. But then you have to show evidence to that effect. Noone can sell something to someone knowing there is a problem and keeping it from the buyer. Even if it says "As is". There is still a responsibility as a seller to a buyer. You just have to prove it...hence your screwed without proof.

I was looking for a boat not too long ago, stopped by DFW Boats to look at a 1995 ZX200 Skeeter w/ a 200 on it that I had seen online. Salesman told me what a great boat is was for the price. At first glance, I agreed w/him, but upon further investigation I discovered a hole about the size of a fist on the underside of the hull, near the transom that went all the way through the glass. "What about this?", I asked. "Oh yeah, we can probably knock a few hundred off of the price for that." Xsqueeze me? I almost ran off the lot. I just looked online and that boat is still there, so buyer beware.

I feel for you, but you're probably not going to get much help out of them.

unfortunately as is means as is. i would think that if it were a dealership that was selling one of their trade in's that they would help, but if they were selling this for someone else i can see how they wouldnt feel obligated to help fix it. if you paid $8K for it, their commission probably wanst that much. might get some recourse if you could prove they knew it was gonna blow, but do you think they really did and if so, how could it be proved. in regards to a previous post, i think if you bought it in texas you abide by texas sales law, not your home states.

thats a tough break and i wish you luck in getting it resolved. they will never get any of my business.

They sound terrible. I will not ever go there for a boat.

Word to the wise, stay away from McGoys Toys across the street in Lewisville. They almost sold me a bad boat. It ran fine until you put the throttle down, then it started sputtering and smoking. The guy that was selling it said, Oh it just needs a tune up. If you by it now we can have it tuned up for you. I said tell you what, you tune it up and call me back. I never got a call back.

At Plano Marine I bought a used 94 Four Winns fish and ski with a Johnson 115. They also sold me a 1 year warrantee on the engine for $500. I didnt need it but it was nice to know I had it. I will not buy another used boat without one.
