With or without the power pole I would want a factory size tank because that is what you had.

One very important piece here, if you fish BASS or any other major tournaments, OR, you plan on selling this boat at some time, this rule could keep that boat from fishing in the tournament. This is from the BASS 2012 Opens Rule Sheet.
Boats that do not have factory-installed gas tanks are restricted to a maximum of 18 gallons of gasoline, in tanks that meet U.S. Coast Guard regulations.

I would take the smaller tank offer and start at $500 for the pole and see what happens. Go up to 6-700 and if that didn't work try the lawyer angle. Say 28 gallons burnable fuel would double my needs. At $6-$8 a gallon 28 will be plenty shortly unless you're trying to beat KVD and lawyers aint free. Good luck whatever you do.

Pop some water weld in the holes and truck on Jk. Legit business wil and should find a way to make it what it was. If i were in the market for a boat i would be real hesitant on buying one with a dif size gas tank than specified. Not that i normally run a long way but would be poed if i couldnt bc a swap out. Of course i wouldnt need a power pole either so. Heck do some reasearching n your own as to a reelacement gas tak or find somebody who claims they can fix it and direct the company to them so they have no excuse to fix it back.

I would do exactly what you have done thus far, Coach. Be patient and let the dealer work it out. They should make your tank right, and they've offered a discount on the PP. IF they can make the tank right, end of story. The discount off the PP was their olive branch for their mistake.
A free power pole in exchange for a fuel tank sounds a little ambitious to me.
And the lawyer route should be a LAST resort. Too many people's first thought these days is SUE!!!
