This is the law that cracks me up... On Grapevine and Worth you cannot have an alcoholic beverage on the bank, but step in to the water or sit on your boat while its beached and you can drink all you want. Even had a cop tell me he better not catch me with an open container on the shore, that I needed to do all of my drinking while I am out on the lake! True story!
Nothing wrong with having a few cold ones while on the lake, just like in anything else just be responsible and know your limits. If your not driving, drink all you want!

I have a couple friends that have the handheld breath analyzers. They are the nicer ones and it is an eye opener just how little it takes to reach .08

I wonder what happens to your car insurance if you get a BWI in a boat with a 40 HP motor? The law talks about 50 HP and over. i am not planning on doing anything stupid but was just wondering. I always thought that was a funny querk in the law. The way the law sounds from the TPWD, if you have under a 50hp motor, you cant get a BWI. Its dumb but it sounds like they are saying that if you have a jon boat with a 30hp motor cruising down the lake (which could reach 20mhp+) you are of no danger to anyone or yourself! How is that right? A 10ft jon boat with a 30hp motor can run like a jet ski and i know that there are some crazy people that would put that motor and boat combo together even though its unsafe. It looks like the only difference with a motor less than 50 hp is that the BWI doesn't automatically suspend your regular driver's license. You can still get a BWI, apparently even in a 10' dinghy with an electric trolling motor.

You can drink alcohol in a boat as long as your of age however some cities have a city ordinance against it so if they do then you can receive a citation for having alcohol. IF one is to get a BWI (.08 BAC) it is the same punishment as getting a DWI including losing your Drivers License.
