Yep, you're right and he is WRONG! I'm a board member of my HOA (and past president) and I've never heard of lights, being in any by-laws, deed restrictions, etc. About the only thing they are ever concerned with, is square feet, manufactured housing and maybe, exterior materials. Unless, of course, you are in some big city sub-division, like where Pres. Bush is moving. Then you would probably have ALL KINDS of restrictions. I think the lawyer advice is the best. Not in Louisiana, on Lake Bob Sandlin neer Pittsburg Texas. Based on what you have previously stated: In Texas, to form a POA, every property owner must be notified. A 100% "yes" vote is required. There cannot be a closed meeting. The vote must follow the Texas Open Meetings Act. Minutes of the meeting and the final vote tally must be kept for inspection. When he told you it was a closed meeting, by invitation only, then there can be no POA. Ask him for a copy of the minutes of the meeting, along the official vote tally. He cannot provide this, so therefore there is no POA. Tell him, the next time you see his dog off his property, you will call animal control. Tell him he is not welcome to cross your property line, if he does, you will call the authorities and have them issue him a trespass citation. Tell him that unless prohibited by federal, state, county, and/or city law (if you live within a city limit), you can do whatever you wish on your property as by definition of Texas law, there is no POA control over you.

I think the people that are trying to form this POA on Sandlin are the same ones trying to do so with my property on Cypress...
Tell them to go fly a kite...

CWCW's post is worth re-reading. He's right there is no POA in the United States of America that will allow unpermissioned entry into your house. None, period. Never. This guy is unstable, because no one in their right mind would even consider such a blatant act unless they are in the process of stealing. . JustJames you should make a sheriff report on this guy. Consult the attorney and all the rest of the good advise here. But really you should get this on record. This guy is NOT a good neighbor. Don't let him push you. Once he thinks he can the problem will escalate. . I saw you are a vet. Me too but I was in after the war and before the 1st Gulf action. Thank you sir.
