Not sure why BBT's statement is not correct. If the restaurant makes 51% of it's sales from alcohol and it is consumed on site you cannot carry in that location. So, he could carry into a liquor store where consumption is not allowed on the premises. Also, businesses just can't throw up a no weapons allowed sign and think that's legal. They have to post what is called the 30-06 sign.
In order to provide notice that entry on property by a license holder with a concealed handgun is forbidden, Penal Code Section 30.06(c)(3)(A) requires that a written communication contain the following language:
"PURSUANT TO SECTION 30.06, PENAL CODE (TRESPASS BY HOLDER OF A LICENSE TO CARRY A CONCEALED HANDGUN) A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (CONCEALED HANDGUN LAW), MAY NOT ENTER THIS PROPERTY WITH A CONCEALED HANDGUN."
I have a CHL, was a cop for 14 years and if I'm going someplace that is a little shady..I'm carrying. I also carry when I travel, but I print out the agreement between the states I'm traveling through and keep them in the glove box.

Saw an interesting article that was forwarded to me from a friend who works for the National Park Service...They are working to make it legal to carry in the National Parks...I think it's a pretty controversial topic. But would make all the gun toters of the USA happy.

See ya on the water, SportFisher I think what is being confused is the "unlicensed" handgun sign posted at establishments that sell beer and liquor. The TABC sign.

I agree some folks get confused with the "unlicensed" signs. I'm also going to say, it's scary with some of the folks that have a CHL, should have seen some of the folks in my class. Didn't even own a handgun and two were in walkers. Had to sit to do the qualification firing. I know they had to punch holes in one guys target.
All I can say...it's only 10hours of your time, get the handbook,read it and don't think since you have the CHL that you're Wyatt Earp. Folks should never know you have it until it's time to use it. You also need to remember that if you get arrested with a misdemeanor, it's upgraded if you have your weapon on you. Can't drink and carry.

See ya on the water, SportFisher I agree, some of the people that have CHL's shouldn't be allowed to even own a sharp object. We I got my CHL, the guy in the booth next to me shot my target! He did the same thing to the guy on the other side of him. On one of my renewals, all one woman wanted to do was shoot someone.

First off BBT statement is incorrect because he states that the "eating places do not allow guns"! Those signs say the UNLAWFUL CARRY OF A WEAPON..." If you have a CHL that excludes you. Notice the sign says UNLAWFUL! Other wise you can be arrested for illegaly carring a weapon period wether the sign is there or not. Thats just the law anyway. SO any store/business can throw up any sign they want. If they want it to include CHL people then it has to be the 30-06 sign. To be safe and this is straight from Austin and instructor/statetrooper you can not carry into a liquor store period. One thing I found out that I got two answers on is if you have a CHL and have your weapon in your posession you CAN NOT consume alcohol AT ALL! Not a drop. Sometimes it gets confusing but it is a big responsiblity to carry a weapon. If anyone has facts/proof I am always wanting to listen. SOmetimes the wording of the laws are so dang confusing.

I carry my CHL Pistol with me hunting on the National Grasslands up in Decatur. They do not restrict any CHL holder from carrying. You just can't use handguns to hunt up there. I carry every time I leave the house except for two locations. My work (US Postal Service) and my wifes work (School). I've been questioned over 5 times on Ray Roberts which last I checked was a Corps lake and never once was told that I was in violation. I see the local GW out on my home lake quite often and they know that I'm a Friend and they've never even asked where it was once I showed them my CHL. I've had a couple of patrol officers seem to break out in the sweats when I stated to them that I was carrying but never gotten any flack from GW or national Park Rangers. It sucks that we have to carry firearms to defend ourselves but the bottom line is I want to be the one to walk my daughters down the isle and I want to retire someday. I don't want some punk taking what I work hard for and if he needs my gun he can have it. BULLETS FIRST!

When you start packing a firearm, be it in the glove box of your car as allowed by the Castle law or on your person under CHL rules, your entire demeanor changes. YOU have sharply increased responsibility for your life and that of those about you. It means you have the means to defend yourself even to the point of taking another human life. You automatically become more alert, you watch people with a different perspective. You become careful and more aware of what is going on around you. YOU START TO AVOID SITUATIONS WHERE YOU KNOW OR SUSPECT YOU MIGHT HAVE TO DEFEND YOURSELF. That is what makes responsible carry safe--those of us who do keep a firearm near by for "just in case" want to avoid that situation at all costs.
That is the difference between the thug who uses a gun to intimidate and even kill to get what he wants and the person who carries responsibly to defend against the thugs of this world.
Well that is not what I started out to say. I started to say if must frequent a "threatening" ramp I would have some means of defending myself along with me. Regardless if you carry legally or not I would rather have the means of self defense and never have to use it than to need it and not have it.

Heres something else for you CHL'ers, you can carry at the State Fair. I know this has been a topic that has been in question but regaurdless if they have people with metal detector wands you can legally carry at the Fair.

Chapter 411, Government Code, regardless of whether the handgun is concealed, on or about the license holder's person: (1) on the premises of a business that has a permit or license issued under Chapter 25,28,32,69, or 74, Alcoholic Beverage Code, if the business derives 51 percent or more of its income from the sale or service of alcoholic beverages for on-premises consumption, as deter40 PCw.035. TEXAS CONCEALED HANDGUN LAWS mined by the Texas Alcoholic Beverage Commission under Section 104.06, Alcoholic Beverage Code; As our instructor beat into us, not all law officers know the laws and may cite you carrying unlawfully. If you're not sure or you may think there is a gray line, leave it in the car. Not everyone on the board has the right answer. It's your weapon and your life...get a license, read the book and check the websites for updated laws. Our instructors recommended we attend refreshers every year at no additional cost on the law portion of the class. The castle doctrine does not allow you to carry a weapon in your vehicle without a license if you are not traveling. It has extended the protection of your home to your car (in cases of car-jacking) and break-ins. Do they somehow "mark" you as a weapon carrying CHL holder? If they do, they are forcing you to violate the law. Being "maked" is no longer having your weapon concealed. The Houston city council chambers put a green stick on spot on those that pass thru the metal detectors and it is being fought out in court now.

The CHL license is a defense from prosecution. It gives your lawyer something to argue in court when you have been charged with a firearm offense.

I'd have to say that you don't read very well. I have taken the class 3 times. Because I want to stay up with the info. As I stated there are different answers from different instructors. This bothers me because of exactly what you say. Different officers may interprut the laws differently. My intructors told me the same thing...if in doubt don't carry it...So if you want to take the chance to carry in a liquor store feel free. There is a difference in a liquor store and a bar. I have read the book and then some. I don't see what your saying and what I am saying are any different about when to carry and where to carry. Maybe it's just like understanding the rules and there interprutations that we are not seeing eye to eye. If you could tell me where you see I am wrong. Honestly if there is knowledge you think I should know then point it out.

I made a call to the City Hall, talked to Angelo Brown who called an talked to Christina Lanners, City Attorney for the Parks Dept. They confirmed it is legal to carry at the Fair. As far as them marking you that was not mentioned. Last year all they requested was that you inform the person at the gate and show ID. Nothing more. Maybe I need to make another call.
