Had an insurance treat me this way one time. Sent a draft of a petition over to them suing their insured. Had a check in hand later that day.

Then, and only then, would her insurance engage.

Even at that rate, I had to fight HARD to get the amount I wanted for the totaled vehicle. And my son wasn't injured in the accident but I still fought for pain & suffering.
And when GEICO told me that my son's mild injuries and missing school due to back pain, and that we were now without a vehicle that we relied on for transportation were all INCONVENIENCES, I about lost my mind.
Told them I was contacting an attorney.
They called the following day and asked if I had contacted an attorney yet. I told them not yet, but will that day. They started the offer process.

It's a PITA.

There are some decent articles on the www about how to negotiate with insurance companies. I read a few and took some advice that applied to our case and I feel that it helped.

This is about the SOP for the scam insurance companies.

Alright.

I called my insurance agent. She told me I can file a a claim against my insurance, get everything fixed, but I will have to pay my deductible.

If the at fault drivers insurance accept fault, they will pay all costs, she talked can’t a subrogation process, where they get everything back including what would be my deductible, but this could be anywhere from right away or months or longer.

Does this sound right?

Best advice I ever got was to record the person at fault right after the accident on your phone. Don't give them a chance to think about it and make up some bull [censored].
I recently got hit by a teenage kid. I hit record on my phone while we were talking and asked him if he was on his phone when he hit me and he admitted he was. When he called his dad his story suddenly changed. I got on the phone with his dad, played the recorded conversation and his dad paid for everything cash.
I still got his DL and insurance (JIC) info but neither insurance company had to get involved.

Parking lot accidents are the worst. I was backing out of parking spot and guy backed into bumper. I was stopped and shifting to drive when he hit me. He admitted fault and I got his insurance info. I told him better to pay out of pocket but he insisted on filing with insurance. I went straight to police station and insisted on filing a report. His insurance company claimed it was a mutual backing situation and did not want to pay. Fortunately damage was slight and just corner of the bumper. They finally covered the cost of a new bumper. I bought an aftermarket bumper, installed it myself and pocketed some money.

If your Agent will just contact the other Agency and discuss the accident date/time/their insured most of the time the other insurance will contact their insured for their side of the story.

I did this and the other insurance paid for the repairs and it didn’t cost me a claim or my deductible.

Plot twist.

I started the claim with State Farm, but had a few more questions before I started.

I asked if I file a claim, and I’m not at fault, will my rate change.

They said they didn’t use to, but now they will take away my “good driver” discount. Which is about $300/yr with our cars.

Back to fighting them directly with my 3rd party claim.

File the claim, then when it’s all done find a new insurance provider. State Farm is terrible.
