You do not have to do the sobriety tests roadside. However, they are going to take you to the station and make you do it there. IF you refuse a breath test or blood, it is an automatic 6 month license suspension. Then they call a judge, get a warrrant and take your blood anyway. IF you get there far in the process, you are going to lose anyway. Also, they can give a DUI for anything that impairs you. That could be anything not just alcohol.

Drunks don't make good decisions as a rule. Just remember, you've got a good chance to beat a rap in court. You have zero chance to beat the police on the side of the road. Those tests are set up so you will fail. Big money in DUI's. Just more government corruption to milk people out of their money.

Those tests are set up so you will fail. Big money in DUI's. Just more government corruption to milk people out of their money. A breathalyzer can give a false positive reading for a number of reasons, including environmental factors, medications, and medical conditions. Environmental factors Chemicals Exposure to paint fumes, gasoline vapors, or other chemicals can interfere with the breathalyzer's sensors Temperature The temperature of the breathalyzer or the environment can affect the reading Medications Cough syrups: Cough syrups that contain alcohol can increase the alcohol content in your breath Cold medicines: Some cold and cough medications contain small amounts of alcohol Other medications: Albuterol, budesonide, and salmeterol can cause false positives Medical conditions Gastroesophageal reflux disease (GERD): Stomach acid can flow back into the mouth, causing a false positive Ketoacidosis: A condition that can cause the body to produce acetone, which can be mistaken for alcohol Low-carb diets: The body produces ketones, including acetone, which can be mistaken for alcohol Other factors Operator error: Untrained officers may make mistakes that lead to false positives Mechanical issues: The breathalyzer device itself may be malfunctioning Fermented foods: Foods like kimchi, sauerkraut, and soy sauce can produce trace amounts of alcohol

I don't drink. But am out in bars on some weekends. Just part of being in the music business. I've had cops tail me leaving a bar. There will be a day that I'm harassed because some power hungry cop thinks he has a drunk driver.

If I'm taking cold medication, I'm staying home anyway. I don't go around spreading my germs. I won't fight them. I will F with them though.

Power tripping Barney pulls you over with the sole intent on giving a DUI. Your language and decisions from that point forward will make Barney's actions fruitless.
