Saw it and have seen several other reports, that statute doesn’t exist, so how can we believe anything they wrote? They can’t even cite the current statute, seems awfully odd to me…lmoa….

Also the statute does exist, I know reading is hard for you so I noted an important detail

Hold up Dre, so you’re saying it’s really statute 66.023 and subsection (d) says that it’s a felony of the third degree if the prizes are worth $10,000 or more? Is that what you mean with the “I can’t read”? Because it’s looking like I can read pretty decently.

Yes, one of the news articles stated that he was charged with a felony and if you read that description above, that is a felony. No where do I see a “class B misdemeanor” in statute 66.023, nor do I find statute “66.119”, so exactly who made up all of these non-fact checking charges in that police department?

Dang. My uncle did 12 years in Tyler awaiting extradition on drug trafficking charges. He had a couple kilos, a bag of loose diamonds, and a case of Dom Perignon in the trunk on his way to my sisters wedding. This was back in the 80’s. Them Tyler boys didn’t like his Mexican plates on his XJ12 . Haha.

Below is from statute 66.023. If the amount you can win is under $10,000 it's a class A misdemeanor, if it's $10,000 or more it's a 3rd degree felony. The way the booking info shows class b/a misdemeanor is a little weird.

(d) An offense under this section is a Class A misdemeanor, except that if the offense occurred during a tournament in which any prize or combination of prizes to be awarded for any one category for which an award is given, whether the prize or prizes are to an individual or a team, is worth $10,000 or more in money or goods, the offense is a felony of the third degree.

The DA obviously chose not to charge with him a Felony for any number of reasons. Maybe because it's actually two separate drawings, or they didn't want to a call a grand jury, whatever the case may be hes not facing a felony

This means nothing. What the sheriff posted on their website does not mean a thing. What matters is what the complaint filed with the clerk says. That is the legal charging document. If someone has a copy of that, please post it. And just because TPWD filed charges, it MIGHT still require county attorney approval. It's possible TPWD consulted with the county attorney prior to the filing of charges however. If someone can find a copy of the arrest affidavit, would be interesting to read the whole thing and not the snippet the news posted.

I don't know why you guys insist that he's being charged with something other than a misdemeanor. A felony requires an grand jury indictment that we would've already heard about
